An aggressive disinvestment agenda and the auction of spectrum for third-generation mobile telephony allowed the government to project non-tax revenue of Rs 148,118 crore in 2010-11, an increase of Rs 35, 927 crore or over 30 per cent from the revised estimate of Rs 112,191 crore in 2009-10. This buoyancy would help it reduce the fiscal deficit to 5.5 per cent of the gross domestic product in the coming year.

In 2010-11, the government has targeted revenue of Rs 40,000 crore from divestment of its stake in public sector undertakings (PSUs). These proceeds are estimated at Rs 25,000 crore in 2009-10; so far, it has raised Rs 12,660 crore and the remaining amount would come from the follow-on issue of NMDC, which values the company at 400 per share. So, the target for 2010-11 is 60 per cent higher. "The government has high hopes from disinvestment," said Satya Poddar of Ernst and Young.

The government diluted a part of its equity stakes in NHPC, NTPC, NMDC and Rural Electrification Corporation in 2009-10. The Budget papers did not name the PSUs in which the government would divest its stake in 2010-11. Some companies that could come to the market are SJVN, Engineers India, Steel Authority of India and Coal India. Only, the recent lacklustre performance of the NTPC and REC issues has put a question mark on the appetite of investors for public sector paper.

The government hopes to get at least Rs 35,000 crore from the auction of 3G spectrum. It had budgeted a similar amount in 2009-10 but could not complete this in time. As a result, its revenue from communication services was Rs 13,795 crore in 2009-10, from the initial estimate of Rs 48,335 crore. In 2010-11, this has been raised to Rs 49,800 crore.

The 3G auction process is slated to start on April 9. The Department of Telecommunications released the notice inviting applications for the auction this week. The last date for applying is March 19, and the mock auction will take place on April 5 and 6.

In West Bengal, Punjab, Himachal Pradesh, Jammu & Kashmir and Bihar circles, four slots will be auctioned; in the other 17 circles, only three slots would be auctioned. In the earlier draft NIA, only three slots were offered for bidding across the country. State-run telecom majors MTNL and BSNL had already been given 3G spectrum to start services.

The spectrum would be available commercially to all the successful bidders from September 1. The government has set the base price for 3G spectrum in metros and Class-A cities at Rs 320 crore and for Class-B cities at Rs 120 crore, while for Class-C cities it is Rs 30 crore. The pan-India reserve price for 3G is Rs 3,500 crore.

The 3G auction, scheduled to start from January 14 this year, was delayed several times amidst differences between DoT and the defence ministry. The new schedule misses the deadline fixed by the finance minister to complete the process before March 31.

The BSE benchmark Sensex on Wednesday regained the psychological 17K-mark after six weeks by ratcheting up 227 points on hectic buying by foreign funds across the counters, stretching the Budget rally to the third day. The market leader Reliance Industries led the rally, gaining by 3.90 per cent after US media reports said Lyondell Basell had rejected the $14.5-billion takeover bid by the domestic petrochem giant for the bankrupt US chemicals major.

The FIIs continued to buy across the board and the demand was so strong that all sectoral indices ended in the green with oil & gas, realty, power,FMCG and banking leading.

Apart from Reliance, JP Associates and Tata Power, NPTC and M&M too aided the market with a 6.14-% and 5.08% rally respectively.

The BSE 30-share barometer remained in the green through out the day after opening 120 points up and closed above the psychological 17,000-mark, a level not seen since January 21, netting a gain of 227.45 points or 1.36% at 17,000.01 points after touching the day's high of 17,012.61. The Sensex surged by 520 points in the past two sessions since the Budget.

The wide-based NSE index Nifty 50 also surged by 71.10 points, or 1.42% at 5,088.10. It touched a high of 5,093.25 points after opening 35.55 points up.

BSNL Disinvestment is the Tip of the Iceberg!A high-level committee headed by Mr Sam Pitroda on Wednesday said it has submitted a detailed report on the restructuring of BSNL. "We have submitted a report containing 15 suggestions to the PM to help BSNL and it is up to the board of BSNL t o debate and discuss those proposals and take further action in consultation with DOT," said Mr Pitroda.

Though Mr Pitroda declined to divulge any detail sources said the report suggests IPO as one of the crucial options before BSNL to resurrect itself in the face of fierce competition.

Sources further added that the Pitroda panel, which also has Telecom Secretary Mr PJ Thomas and HDFC Chairman Mr Deepak Parekh as members, has suggested scrapping of the controversial 93 million GSM line tender, which has been put on hold by BSNL followi ng a directive from the Central Vigilance Commission (CVC) over allegations of corruption.

BSNL has been suffering a serious decline in revenues and profitability for the past few years. Its financial health became so serious that PM Manmohan Singh called for a review in January 2010. Singh directed that a three-member committee be set up, which should submit its recommendations within a month. The committee, headed by technocrat Sam Pitroda, after conducting three meetings and a series of discussions within DoT, and with consultants, lawyers, investment bankers and other stakeholders, has delivered some carefully crafted recommendations to the PM.

The most important includes 30% disinvestment in stages after fundamental changes have been made to enhance enterprise value through an Indian strategic investor and an IPO. Of the raised money, 10% would be returned to the government, and 20% would be used for employee VRS, expansion and operations. Further disinvestment would also be considered after a detailed performance review in three years.

The committee, which has banker Deepak Parikh and DoT secretary P J Thomas as members, has recommended that the quality of senior executives and management teams needs to change drastically. It wants BSNL to employ the best talent at market rates for higher levels of management. Internal candidates should be given equal opportunities, but not preferential treatment. The ToI was the first to report in its February 1 edition the leadership issues plaguing BSNL and the need to seek out external talent.

The committee recommends approaching an eminent person from the private sector with strategic vision and status to interface with the external environment as the chairman to focus on shareholder value. Separate positions of MD and CEO should be appointed with domain expertise, along with autonomy to manage day-to-day operations.

वाली एक उच्चस्तरीय समिति ने सिफारिश की है कि सार्वजनिक क्षेत्र की दिग्गज दूरसंचार कंपनी बीएसएनएल में एक रणनीतिक भारतीय निवेशक को शामिल करने के बाद उसमें 30 फीसदी हिस्सेदारी बेच दी जाए। सार्वजनिक क्षेत्र के इस उपक्रम में जान फूंकने से जुड़ी अपनी सिफारिशों में समिति ने लैंड बैंक और टावर इंफ्रास्ट्रक्चर जैसी बीएसएनएल की दूसरी परिसंपत्तियों से पैसा बनाने की बात भी कही है। दूरसंचार क्षेत्र में होड़ बढ़ने और लालफीताशाही की वजह से यह कंपनी मुश्किलों में घिर गई है।

समिति ने बीएसएनएल के कामकाज में दूरसंचार विभाग (डीओटी) की दखलअंदाजी घटाने की वकालत भी की है। उसने कहा है, 'मंत्रालय को केवल बोर्ड प्रस्तुतिकरण और बोर्ड बैठकों के जरिए बातचीत करने की इजाजत दी जाए, न कि रोजमर्रा के नीति-निर्माण, इंटरफेसिंग और निगरानी के माध्यम से।'एक महत्वपूर्ण सुझाव बीएसएनएल की खरीद प्रक्रियाओं से जुड़ा है। समिति ने बेमतलब की देर और कानूनी विवादों से बचने के लिए ई-खरीद और वेंडर रेटिंग जैसे टूल की सिफारिश की गई है। बीएसएनएल ने मई 2008 में 9.3 करोड़ जीएसएम लाइंस के लिए टेंडर जारी किया था, लेकिन वह विवादों में घिर गया है जिससे तेजी से विस्तार करने की इसकी क्षमता को चोट लगी है।

समिति की सलाह है, 'होड़ में बने रहना हो तो बीएसएनएल को नेटवर्क ऑपरेशन, आईटी और कॉल सेंटर के लिए प्रबंधित सेवाओं का विकल्प चुनना चाहिए।' बीएसएनएल के कामकाज का तरीका सुधारने के लिए दिए गए कई सुझावों के अलावा रिपोर्ट में वरिष्ठ अधिकारियों की कार्यकुशलता बढ़ाने और प्रतिस्पर्धी कारोबारी हालात में त्वरित निर्णय प्रक्रिया पर जोर दिया गया है। मशविरा दिया गया है कि बीएसएनएल को अपने तीन लाख कर्मचारियों में से कम से कम एक तिहाई को या तो स्वैच्छिक सेवानिवृत्ति योजना (वीआरएस) जैसे तरीके से रिटायर करना चाहिए या उनका तबादला करना चाहिए। इसके अलावा, टेक्नोलॉजी, आईटी, मार्केटिंग, कस्टमर सर्विस और सेल्स में युवा टैलेंट को जगह दी जानी चाहिए। इन सुझावों का उद्देश्य बीएसएनएल को एक निजी कंपनी की तर्ज पर काम करने वाले इकाई में बदलना है।

विनिवेश मामले पर समिति ने एंटरप्राइज वैल्यू बढ़ाने के लिए बुनियादी बदलाव करने के बाद चरणबद्ध तरीके से 30 फीसदी हिस्सेदारी बेचने की बात कही है। बीएसएनएल के पास 88,000 करोड़ रुपए की परिसंपत्ति है और उसका सालाना टर्नओवर 35,000 करोड़ रुपए है। समिति ने कहा है, 'आईपीओ से जुटाई जाने वाली 10 फीसदी रकम सरकार को लौटाई जानी चाहिए, जबकि 20 फीसदी अंश को कर्मचारियों के वीआरएस, विस्तार और कामकाज में लगाया जाना चाहिए। तीन साल में प्रदर्शन की ब्योरेवार समीक्षा के बाद इसमें आगे विनिवेश पर गौर किया जा सकता है।'

Govt foregoes Rs 5.02 L cr in taxes in FY10: Finmin

The Government during 2009-10 is estimated to forego revenues of over Rs 5 lakh crore, which amounts to 50 per cent of its annual expenditure due to various tax concessions given to the prop up the industry hit by the global financial turmoil.

"The amount of revenues foregone continues to increase year after year...to reverse this trend, an expansion in the tax base is called for," said Finance Ministry while providing details of revenue foregone in the Budget papers.

The revenue foregone is estimated to rise from Rs 4.14 lakh crore in 2008-09 to Rs 5.02 lakh crore in the current fiscal. As a percentage of aggregate tax collection, the tax forgone will move up from 68.59 per cent 79.54 per cent during the same period.

"As a percentage of aggregate tax collection, the revenue foregone remains high and shows an increasing trend as far as corporate income tax (is concerned)... for the financial year 2008-09. In case of indirect taxes, the trend shows a significant increase for 2009-10 due to reduction in customs and excise duties", the papers said.

Revenue foregone assumes significance when compared with the Government's total expenditure which was a little over Rs 10 lakh crore during 2009-10 after hiking public outlay to provide relief to the crisis-hit industry.

Revenue foregone on account of customs duty concessions amounted was to the tune of Rs 2.49 lakh crore followed by excise at Rs 1.71 lakh crore, corporate tax at Rs 79,554 crore and personal income tax at Rs 40,929 crore, reveal the Budget papers.

The only saving grace was the export sector, but that was because of wrong reasons. Revenue foregone on account of tax concessions provided to export promotion schemes dropped to Rs 43,622 crore from Rs 49,053 crore during 2008-09, mainly on account of slowdown of shipments due to crisis in the developed countries.

As regards the corporate taxes, the Budget papers reveal that effective rate during 2008-09 was 22.8 per cent as against the actual rate of 30 per cent plus education cess and surcharge.

The Finance Ministry's analysis was based on tax returns filed by over three lakh companies and business entities.

Companies take advantage of various concessions to reduce tax liability, while individuals park their funds in tax savings scheme to reduce tax burden.

On the indirect taxes side, the government provides tax holidays to encourage specified sectors and incentives to promote exports.

As part of his Budget proposals for FY2011, Finance Minister Pranab Mukherjee raised the incidence of minimum alternate tax to 18 per cent from 15 per cent. The decision is aimed at raising tax realisation from corporate.

The government has rapped state-owned Bharat Sanchar Nigam Ltd (BSNL) for poor financial performance and made a case for disinvestment through an initial public offer (IPO).

"I hope the BSNL IPO happens in the coming year (2010-11). I can't say exactly when, but I certainly hope that it does happen, because BSNL does need to open up to public ownership, primarily with a view to strengthen its own management and its accountability," Disinvestment Secretary Sunil Mitra told a private news channel.

The public sector unit (PSU) has been negotiating with the trade unions, which have been opposing any disinvestment. The unions say disinvestment or listing would serve no interest of people. The government had earlier proposed to divest 10 per cent stake.

"The company's financials are doing pretty badly and it certainly shouldn't be so because telecom, as you know, is one of the sectors that you have to be competitive and they (BSNL) have to pull up," Mitra said. The government may announce a roadmap for disinvestment in PSUs through IPOs and follow-on public offer (FPOs) by March this year and BSNL could be one of the 60 PSUs identified by the government.

BSNL, which was eyeing a top slot in the mobile market at one point of time, is struggling to retain its fifth position in the market. The company is also in the process of adding to its Global System for Mobile Communications (GSM) capacity, at an investment of over Rs 35,000 crore. It had floated the tender nearly 18 months ago. Being a government-owned company, it has faced bureaucratic hurdles in placing orders with the lowest bidders. Disinvestment and listing are expected to help the PSU take decisions faster and compete with the private sector.

PM, Advani indulge in war of words; opposition tears into Pawar

New Delhi: Prime Minister Manmohan Singh and Bharatiya Janata Party (BJP) leader L.K. Advani locked horns in the Lok Sabha Wednesday over "secret talks" on Kashmir and the implementation of one-rank-one-pension scheme for defence personnel while the opposition tore into Agriculture Minister Sharad Pawar in the Rajya Sabha on an alleged sugar scam.

The prime minister attacked Advani for trying to create a "rift between service personnel" and the government. The BJP leader had alleged that a promise made in the 2009 budget - on the one-rank-one-pension scheme for ex-servicemen - had not been implemented completely.

"Whatever I have promised, my government has done. Whatever the finance minister stated in the budget, it has been implemented," Manmohan Singh said.
Advani also referred to a Newsweek report, which quoted Indian and US sources as saying that India and Pakistan have restarted "secret back-channel talks" over Kashmir, and asked the prime minister for an explanation.

Manmohan Singh said: "How many times did Jaswantji (who was external affairs minister in the NDA government) talk with US government representatives? How many times you informed the house? Why are you expecting me to answer hypothetical questions?"

In the Rajya Sabha, an unrelenting opposition led by the BJP heckled Pawar throughout his 70-minute reply to a short duration discussion that was held last week on the rising prices of essential commodities, accusing him of misleading the house and not addressing the concerns raised by them.

They also wanted him to speak on the fuel price hikes but the presiding officer, P.J. Kurien, disallowed this, saying it could be taken up during the debate on the budget for 2010-11.

So intense were the protests that Kurien, at one stage, even threatened to name Bahujan Samaj Party MP Brijesh Pathak if he didn't resume his seat and let the minister continue.

"Don't cross the Lakshman Rekha," Kurien repeatedly said as opposition MPs Brinda Karat (Communist Party of India-Marxist), D. Raja (Communist Party of India), joined Leader of Opposition Arun Jaitley, S.S. Ahluwalia and Ravi Shankar Prasad of the BJP to repeatedly interrupt Pawar and demand that he answer their specific queries, particularly relating to the sugar scam.

Kurien even rejected a point of order raised by Ravi Shankar Prasad, saying: "The chair cannot direct the minister to reply in a particular manner."

In the midst of the continuous barracking, Pawar gamely soldiered on, saying there was no scam as the government had not imported any sugar and had left this to private parties.

This did not satisfy the BJP MPs, who stormed the speaker's podium as Pawar said above the din: "I can assure this house that not a single kilo of sugar has been imported by the government of India. We have left this to private parties."

This comment came after a fiery Karat pointed to what she termed "the dubious role of state agencies in not importing sugar and leaving this to the private trade".

As he finished, Kurien adjourned the house at 3.10 p.m. till 4 p.m.

When the house reassembled, it took up the motion of thanks to the president for her address to the joint session of parliament last Monday.

In the morning, both houses witnessed tumultuous scenes as opposition MPs demanded a rollback of the fuel price hikes, saying they would have a cascading effect on the already high prices of essential commodities and vegetables.

In the Lok Sabha, Speaker Meira Kumar adjourned the house till 12 noon soon after it assembled and Deputy Speaker Karia Munda then did so till 2 p.m.
When the house reassembled, it took up the motion of thanks for the president's address.

In the Rajya Sabha, Chairman Hamid Ansari first adjourned the proceedings till 12 noon and Deputy Chairman K. Rahman Khan did so till 2 p.m.

Government not to defer plans to sell stakes in PSUs

NEW DELHI: The government will not defer plans to sell stakes in public sector undertakings (PSUs), required to bridge its yawning fiscal
deficit, despite a poor response to two of its recent sales, a finance ministry official told Reuters on Tuesday. The government has raised Rs 12,740 crore via divestment in PSUs since May 2009.

Government has outlined share sales to cut its fiscal deficit that is running at a 16-year high, but lacklustre response to the Rural Electrification Corp and the NTPC issues have raised doubts whether the government can get good valuations if it presses ahead with its current sales schedule. Finance Minister Pranab Mukherjee said that the fiscal deficit would fall to 5.5% of GDP in current fiscal.

"No, there is no question of postponing scheduled stake sales in public sector companies which are in line for disinvestment," said Sidhartha Pradhan, a joint secretary in the ministry who is in charge of stake sales.

A $754.4-million share sale in Rural Electrification Corp was barely subscribed by Monday, a day before the issue closed. The wan appetite was preceded by a similar reaction to a $1.8 billion share sale in NTPC.

Analysts have said the response to the REC offering would be a litmus test for the government's plans to offload stakes.

The share sale plans include those in state-run miner NMDC, expected to raise $3 billion by end-March, Steel Authority of India Ltd, Hindustan Copper, power producer Satluj Jal Vidyut Nigam Ltd, Coal India and telecoms firm BSNL.

FM tunes into the regulators

discussed in the meeting is not known. But given that the central bank is the manager to the government's market borrowing programme, it is in the Centre's interest to ensure that there is some coordination between the two. This convention has now been extended to the capital market regulator. Now, the FM addresses the Sebi board too after the Budget. Mr Mukherjee will visit Mumbai to address the Sebi and RBI boards on Saturday.

The search is on
S S Kohli, the chairman of India Infrastructure Finance Company (IIFCL), will complete his term next month. The government has already constituted a search committee to select his successor. There could be a number of contenders considering that almost 10 CEOs of state-owned banks are due to retire this year. Like Mr Kohli, who joined IIFCL after he turned 60, these bank chiefs will also be fancying their chances.

Disclosure worries
The Reserve Bank of India has asked banks to disclose how much commission they receive from life insurance companies for selling their products. But the insurance regulator has not yet managed to push through such a disclosure. This is because insurance companies are reluctant to disclose how much commission they pay to their individual clients. Although there have been suggestions from some quarters that disclosing commission would increase transparency and reduce mis-selling, companies are worried that such a disclosure may not go down well with insurance agents.

High-profile exit
Abhijit Sen, Citi's CFO in India, has put in his papers. He is set to join Sanjay Nayar, who heads private equity firm KKR in India. Mr Sen has been in Citi for the past 15 years and had received a two-year extension after his retirement in November 2009. He is regarded among the best CFOs by his peers in the industry. Incidentally, a few years back when he was looking to quit the bank, Mr Nayar was the person who had persuaded him to stay. As an interim arrangement, his place will be filled by Anuratna Chadha, who currently heads the private banking business of the bank in the country.

Is socgen exiting pvt banking?
What is happening at Societe Generale's private banking business in India? The group has told some of its staff in the unit to look for job openings outside in the next couple of months even as headcount is already down to 39 from 45. Sources claim that the bank has apparently taken this decision after it found that the costs were not commensurate with revenues. Bank officials, however, claim that it's only looking to realign its business in the country and focus on clients who have a net worth of $25 million and above. Considering that its AUMs have fallen after the financial crisis, it would be surprising to see how the bank survives in the higher-end of private banking business.

Fall in complaints
The firm action against recovery agents is beginning to show results. It may be recalled that last year RBI had issued a dos and don'ts directive for recovery agents. The Annual Report on Banking Ombudsman Scheme shows that while complains received by ombudsman in all category has gone up, it has fallen in case of direct selling agents and recovery agents. Banks received 3,018 complains in this category in 2008-09 against 3,128 in previous year. But then, 3,000-odd complains, by no means, is a small figure.

PSUs to raise over Rs 56,000-cr via bonds, debentures

NEW DELHI: State-owned companies led by power sector PSUs will be raising over Rs 56,000 crore debt from the money market during 2010-11,

representing an increase of about 26 per cent over the current fiscal.

This will be in addition to Rs 3.45 lakh crore, which the government will be borrowing from the money market to bridge the fiscal deficit, the gap between receipts and expenditure during the next fiscal.

As per the budget papers, the power sector PSUs include NTPC and Power Grid Corporation, will be issuing bonds and debentures of over Rs 20,232 crore in 2010-11 as against Rs 14,500 crore in the current fiscal.

Although the PSUs will be raising about 26 per cent more as debt, the market borrowing of the government is slated to drop during 2010-11 to Rs 3.45 lakh crore from Rs 3.98 lakh crore in the current fiscal.

Having partially withdrawn the stimulus, the government will be focussing on raising revenue by increasing the central excise across the board by 2 percentage points and containing outgo towards fertiliser subsidy.

On account of various steps taken by the government, the fiscal deficit of the centre is slated to moderate to 5.5 per cent of the GDP from 6.7 per cent in the revised estimates for the current fiscal.

The second Union Budget delivered by Mr. Pranab Mukherjee was better than market expectations with the focus shifting towards fiscal consolidation while ensuring that the growth trajectory is maintained.  The budget also addressed some of the key medium term issues like the implementation of the GST and direct tax code by April 2011. The government has laid out a road map to reduce fiscal deficit (including below the line items) to 5.5% in FY2011 and 4.1% by FY2013 from 7.2% in FY2009 and 6.9% in FY2010 respectively. The Indian economy is expected to grow by 7.2% in FY2010 as compared to a growth of 6.7% witnessed in FY2009. The Indian economy is expected to accelerate in FY2011.

The Union Budget has announced that gross tax receipts for FY2011 are estimated at Rs, 746,651 crore while non tax revenue receipts are estimated at Rs. 148,112 crore. Planned expenditure is estimated to grow by 15% to Rs. 373,092 crore while non plan expenditure is estimated to grow by 6% to Rs. 735,637 crore. The net Government borrowings for FY2011 are estimated at Rs. 345,010 crore.

The Government has also emphasized on inclusive development with an increase in spending on social sector being increased to 137,674 crore representing 37% of the total plan outlay for FY2011. Moreover another 25% of the plan allocations are devoted to the development of rural infrastructure. Plan allocation for school education has also been increased by 16% to Rs. 31,036 crore. Defense outlay for Fy2011 has been increased from Rs. 141,703 crore to Rs. 147,340 crore.

Partial rollback of stimulus

With a pick up in economic activity the Government has begun the process of rollback of the stimulus package with a 2% hike in basic excise duty to 10%. The service tax rate has been left unchanged at 10% to bring it in line with the basic excise duty. This is in line with the Government's vision of implementing the GST regime which is important as it would complement the proposed direct tax code which is likely to be implemented from April 2011.

The Government has clarified that it would continue export sops and has extended the 2 per cent interest subsidy given to exporters on rupee export credit on certain items till March 2011 in order to help Indian exports sustain growth and stabilize it at 15 to 20 per cent.

Implementation of GST

The Government has pushed back the deadline for implementing GST from April 1, 2010 to April 1 2011. This has happened because some of the states were not ready for implementation of the GST as some of them feared that they may lose financial autonomy while others just fear the novelty of the tax in the country.

Securities Transaction Tax

As expected the government has left the STT unchanged. STT is now charged at the rate of 0.125 % both on the buyer and the seller for equities in the case of delivery-based transactions, a paltry 0.025 % for day traders and 0.017 % for the derivatives segment.

Deficit reduction through disinvestment

The Government has re iterated its intention of offloading partial stake in approximately 60 state-owned companies over the next couple of years which includes steel giant SAIL, coal major CIL, telecom giant BSNL. The government would come out with a detailed action plan for offloading its stake in PSUs by March which would be to ensure maximum returns for the government and bigger retail participation. The disinvestment target for Fy2010 and FY2011 are pegged at Rs. 25,000 crore and Rs. 40,000 crore respectively.

Savings & investments rate in India

Due to the financial crisis in 2008 -2009 there was a decline in the gross domestic savings rate as a ratio of GDP to 32.5% in Fy2009 from 36.4% in FY08. Also, the domestic capital formation rate also declined from 37.7% to 34.9%.The fall in savings rate was largely on account of deteriorating public finances on account of the fiscal stimulus which led to a sharp rise in fiscal deficit from 2.7% of GDP in FY2008 to 6.2% of GDP in FY2009. A large part of the decline in the gross savings ratio is due to a deep contraction (of 68%) in the growth of public sector savings over the preceding year.

However household savings that saw a minimal impact in FY09 which points to the resilience of the Indian economy. The savings and investment rate in FY2010 were relatively unchanged from FY2009 at 32.5% and 34.9% respectively largely on account of high fiscal deficit and a tepid growth in investment demand. The savings and investment rates as a ratio of GDP are expected to resume their pre-crisis growth trajectories from FY11 onwards on account of increased momentum in economic activity manifesting in higher GDP growth.

Higher GDP growth rates coupled with fiscal consolidation through expeditious expenditure reforms would lead to lower fiscal deficits which will augur well for India's impressive growth story remaining intact in the long run.

Direct Tax

Some of the major highlights of the Union Budget with regards to direct taxes are as follows:

The basic income tax exemption limits for individuals, women & senior citizens were left unchanged at Rs. 160,000, 190,000 and 240,000 respectively. However the slabs were broadened which would increase the disposable income in the hands of the common man and at the same time is a step forward towards implementing the direct tax code by April 2011.

For individuals a further amount of Rs. 20,000 would be tax exempt over and above the limit under Sec 80(C) if invested in long term Infrastructure bonds as notified by the Government.

As expected corporate tax rates have been left unchanged at 30% for FY2011. India Inc would have to wait for fiscal 2011-12 for the rate to be 25 per cent as proposed in the draft Direct Tax Code. However surcharge was brought down from 10% to 7.5%.

Rate of Minimum Alternative Tax (MAT) has been increase from 15% to 18% of book profits which would impact the profitability of companies currently paying MAT. Weighted deduction on expenditure incurred on in-house R&D enhanced from 150% to 200%.

Indirect Taxes

Some of the major sector specific highlights of the Union Budget are as follows:

The specific rates of duty applicable to portland cement and cement clinker are also being adjusted upwards proportionately. Similarly, the ad valorem component of excise duty on large cars, multi-utility vehicles and sports-utility vehicles are being increased by 2 percentage points to 22 per cent.

The basic duty on crude petroleum is being restored to 5 per cent while duties on petrol and diesel are being increased to 7.5 per cent. The duties on other refined products are being raised to 10 per cent. Central Excise duty on petrol and diesel are being enhanced by Re.1 per litre each. Scheme of one per cent interest subvention on housing loan upto Rs.10 lakh, where the cost of the house does not exceed Rs.20 lakh which was announced in the last Budget has been extended by one year till March 31, 2011.

Conclusion

Overall the Union Budget was above market expectations and paved the way for fiscal consolidation while maintaining the growth trajectory. In the Union Budget the government has also provided clarity on implementation of GST as well as the proposed direct tax code.

BSNL WORKERS ON STRUGGLE AGAINST DISINVESTMENT : V.A.N.Namboodiri

The announcement by the Minister of Communications & IT, A. Raja, on
14th January 2008, that the Government is proposing to divest 10% equity
in BSNL through IPO route, was not unexpected. However, announcing the
same to the press in a secret way on the sidelines of the function of
launching the Free Accident Insurance Scheme for the subscribers of
BSNL, in which the representatives of the Unions were also present,
smacked of conspiracy and mischief. It seems that the intention was to
convey to the public that the unions are in support of the same.

The government has been toying with this idea ever since BSNL was
converted as a PSU from the earlier Department of Telecommunications. In
fact, the main hidden agenda for corporatisation of DOT itself was
disinvestment and privatisation of this mega telecom company having a
profit of thousands of crores of rupees. The NDA government had brought
the then Disinvestment Minister, Arun Shourie, as the Minister of
Communications for this specific purpose. However, the declaration of
general elections temporarily put the scheme under carpet.

Disinvestment of BSNL along with many other PSUs was a priority with the
UPA government also. However, due to the strong opposition from the Left
parties, the government had to agree that profitable PSUs would not be
privatised. The strong reaction of the state governments and the people
of the concerned states as also opposition from the workers compelled
the government to drop its decisions to disinvest NALCO in Orissa and
Neyveli Lignite Corporation in Tamil Nadu. The disinvestment programes
were put in cold storage temporarily. The government wanted
disinvestment of oil PSUs and LIC also. But amendments to the Acts of
Parliament on the basis of which the PSUs were formed were necessary.
However, this was not possible, as the government does not have majority
in the house without the support of the Left parties, which are
completely opposed to the proposal of disinvestment and privatization.
In the case of BSNL, formed by an administrative decision of the
government, there is no need to approach the Parliament. This seems to
be one reason that the government is emboldened to moot the present
proposal.

While the launching of Insurance Scheme for customers was the programme
for which the press and others were invited on 14th instant, most of the
newspapers and TV channels focused the 10% disinvestment only. It seems
that the management also wanted it the same way. The Economic Times
wrote an editorial supporting the move. S.D.Saxena , Director (Finance)
BSNL, who was present, is quoted as stating that BSNL is valued at $ 100
billion and 10% IPO will mean $ 10 billion or Rs. 40,000 crore. The
media hailed this offer of Rs.40,000 crore as the biggest in the
country. The Multi- National Corporations and Indian big business were
happy that at last an opening was being made for the privatisation of
BSNL, No.1 telecom company in the country and 7th largest in the world.

IS DIVESTMENT JUSTIFIED?

The management justified the divestment proposal stating that the
company requires about Rs.15,000 crore for immediate expansion. The fact
is that there is no dearth of money with BSNL. There is a cash balance
of about Rs.40,000 crore which can be utilised for expansion and
development. When questioned by the press, Director (Finance) had to
agree that finance is not for the present expansion, but for future
expansion. It is thus clear that there are sufficient funds with BSNL.
The complaint of employees against the Management and government is that
they are not taking necessary steps for expansion, utilising the
available funds.

FINANCIAL VIABILITY

ASSURANCES VIOLATED

At the time of Corporatisation of DOT to BSNL in 2000, it was assured by
the Government that BSNL will be given all assistance to ensure its
financial viability in the fierce competitive market. Payment of Access
Deficit Charge (ADC) was assured to BSNL to compensate the loss in
providing telephones in lakhs of villages and rural areas which are
non-profitable, but socially essential, as per commitment of the
Government. It is to be mentioned here that no private company was
prepared to provide connections in the loss making areas, even though
they were bound by the license conditions to do so. No action was taken
against these private companies for breach of license conditions.
Instead, decision has been taken to stop the ADC being paid to BSNL. It
was also assured that the annual Licence Fee, which BSNL have to pay to
the government, just like any private company, will be reimbursed. For
the last two years, this has been discontinued.

Universal Service Obligation Fund was another mechanism through which
assistance was to be provided for the unviable provision of connections
in rural areas and villages. There was an amount of about Rs. 13,000
crore in the USO Fund, but only a nominal amount was paid all these
years to BSNL, which alone was eligible for the compensation. Now the
major portion of the Fund will be paid to the private companies by
making the mobile connections also eligible for compensation. Thus, one
after another, all the concessions given to BSNL, the incumbent
operator, have been taken away putting it in a tight spot.

BLOCKING DEVELOPMENT

BY GOVERNMENT

There is huge demand for BSNL mobile connections, since it is
transparent and cheaper. Nevertheless, the incapacity of the management
and the anti-PSU policy of the government combined have almost choked
the growth of BSNL. In 2005, BSNL floated a global tender for 45.5
million GSM lines considering the large demand for mobiles. Purchase
order could not be issued as M/S Motorola questioned the tender in the
court. The case was dismissed in April 2007 and the purchase order was
going to be issued shortly. At his stage, the new Minister of
Communications & IT, A. Raja, intervened and wanted the tender to be
cancelled, on the plea that the cost is higher, compared to the tender
finalised by MTNL. The Minister conveniently forgot the technical
difference as also the difference in ratio of 2G and 3G lines in the
tenders. The tender was reduced to 50% of the original and purchase
orders issued to Ericsson for 13.5 million GSM lines only. The second
bidder, Nokia refused to accept the purchase order for the balance 9.5
million, since the price was arbitrarily reduced. It was reoffered to
Ericsson, which also refused.

The result is that BSNL is not having GSM lines at present to provide
mobile connections. Where it used to provide about 15lakhs connections
in a month, it is not even able to provide half of it now. As a result,
BSNL has gone down to the fourth from the earlier second position in the
number of mobile connections, behind Bharti, Reliance and Vodafone.
Idea, which has only license for 7 out of 22 circles, is just behind.
The intervention of the Minister and the lack of vision of the BSNL
management had cost BSNL heavily.

11TH JULY 2007 STRIKE

The Joint Forum of Unions/ Associations of Non-executives and Executives
in BSNL was compelled to organise a strike on 11th July 2007 to save the
deteriorating situation and compel the management and government to take
effective decisions and actions to ensure that the lines and
infrastructure are provided to the BSNL for effective service to the
people. The strike was a complete success. It was deferred after one day
on the assurances of the management and Government that immediate steps
will be taken to improve the situation. However, no serious effort seems
to have been made in that direction. BSNL is still lacking GSM lines for
providing mobiles to the people who are in the waiting list. Assurance
by the Minster and the management that a new tender for 50 – 60 million
lines will be floated in August 2007 is yet to be implemented. No
temporary arrangement is made to get the lines as assured.

VOLUNTARY RETIREMENT
SCHEME (VRS)

In preparation for disinvestment /privatisation of BSNL, the management
wanted to retrench 20,000 non-executive employees through VRS. The issue
has been shelved for the present due to strong protest and agitation by
the Unions, but the proposal has not been dropped.

NAVARATNA STATUS TO BSNL

BSNL, on of the biggest PSU with excellent/ very good grade for he last
three years and a profitable one all these years is not granted
Navaratna status so far despite many assurances. The status is denied on
one count or other. BSNL should be declared as Navaratna without further
delay. It will give more autonomy to the Board, which is necessary

ABSORPTION OF ITS OFFICERS

About 2000 Indian Telecom Service (ITS) officers who belong to the top
level management and who are the leaders to take decisions and to ensure
its implementation are not yet absorbed in BSNL. They continue in
Government service and are on deputation to BSNL. This unhealthy
situation has adversely affected the functioning of the entire system.
The government and management should take immediate action for ITS
absorption, failing which there will be serious repercussion on service.

PENSION – GOVERNMENT

IMPOSE MORE BURDEN ON BSNL

As per agreement at the time of corporatisation, Government agreed to
pay pension of the BSNL optioned DOT employees. Management will pay
pension contribution for the existing employees to Government. CCS
(Pension ) Rules were amended by adding Rule 37-A for this purpose. The
Government issued another order on 15th July 2006 asking the BSNL
management to pay the Government additional money if the total pension
is more than 60% of what BSNL pays to the Government towards dividend,
Licence Fee, tax etc. The workers demand that this arbitrary and unjust
order should be cancelled.

INDEFINITE STRIKE

FROM 26TH FEBRUARY 2008

To oppose disinvestment, as also for settlement of the above mentioned
demands, the Joint Forum of BSNL Unions/Associations have decided to
organise an indefinite strike from 26th February 2008. There is no
economic demand of workers. The demands are all related to the
existence, development and growth of BSNL.


PSUS ARE PUBLIC

WEALTH – SAVE THEM

BSNL is the property of the Nation, the people. It has 37,000
offices/exchanges through out the country with lakhs of acres of prime
land in the centre of cities. During the period from October 2000 to
March 2007 ( six and half years), BSNL had a total Revenue of Rs.
2,14,474.10 crore and a net profit of Rs. 41,409.04 crore after paying
the Government Rs. 29,511.77 crore towards dividend, Licence fee, taxes
etc. Its asset will be more than Rs. 40, 00,000 crore by even the most
conservative estimate.

Out of the three PSUs carved from the Department of Telecom, Videsh
Sanchar Nigam Limited (VSNL) was sold to Tata for a paltry amount of
Rs.1,320 crore, while in addition to hundreds of acres of prime land,
building and infrastructure, it had a liquid cash balance of Rs.1,200
crore. 45 % shares of Mahanagar Telephone Nigam Limited (MTNL), the
second PSU are already divested and any further divestment will convert
it in to private. It is to be pointed out here that disinvestment has
not benefited MTNL in any way. In fact, the profit has only decreased.
We cannot allow the BSNL to go the same way. It should not be sold or
destroyed. It should continue as PSU, grow and expand for the benefit of
the people. We request the working class, political parties,
well-wishers and people of this country to support this just cause and
compel the government to stop from the unwarranted path of disinvestment
/ privatisation of BSNL.
