Gujarat's former minister Amit Shah Sunday joined the other accused in the 2005 Sohrabuddin Sheikh killing at the historic Sabarmati Jail here, where Mahatma Gandhi, Sardar Vallabhbhai Patel and Lokmanya Bal Gangadhar Tilak were imprisoned during the freedom struggle.
Shah, sent to 14 days judical custody, has been lodged in the Sardar barracks, named after Sardar Patel, who was once confined there. The former minister of state for home has been permitted home-cooked food.
The other 15 accused in the case, including Deputy Inspector General of Police D.G.Vanzara and and Superintendents of Police Rajkumar Pandian and M.N. Dinesh, are lodged in a barrack adjoining the Sardar barracks.
Strict instructions have been given to the jail authorities to keep them segregated from Shah.
Shah, who made a dramatic appearance before the media at a press conference of the state BJP chief here before leaving for the Central Bureau of Investigation (CBI) camp office in Gandhinagar to surrender, was given a ceremonial send off from the party office with an 'arti' and vermillion applied to his forehead.
As Shah, accompanied by BJP leaders, reached the CBI office, DIG P. Kandaswamy came racing outside, informed Shah of his arrest and requested him to accompany him. The former minister was whisked away to the residence of CBI judge A.Y. Dave, who sent him to judicial custody as the CBI did not seek his remand.

Shah arrested, sent to judicial custody!
Protesting the arrest of former minister Amit Shah, the State BJP held a mute rally on Sunday, where hundreds of party workers marched with black cloth around their mouth, amid heavy rains.
Senior leaders of the party including party president R C Faldu and MLAs from the city participated in the rally where there was no slogan shouting against the CBI or the Congress. But the partyworkers carried banners with anti-CBI and anti-Congress slogans.
The rally was held immediately after the arrest of Amit Shah by the CBI in connection with the Sohrabuddin fake encounter case of 2005.
BJP spokesperson Vijay Rupani said that similar rallies would be taken out tomorrow in cities like Surat, Rajkot, Vadodara, Bhavnagar, Jamnagar and Junagadh.

Sensing trouble over the demand for caste census in the Parliament session starting Monday, the government has urged political parties to submit their opinions to finance minister Pranab Mukherjee who is heading a GoM on the issue. Parliamentary affairs minister Pawan Kumar Bansal said the government will take it further once the replies are received.
Bansal told reporters on Friday that a few replies had been received to the letter written by Mukherjee to political parties seeking their views on including caste as a factor in census.
Also, the Centre has listed the women's reservation bill in the agenda, raising speculation if it will be brought to Lok Sabha. "We hope to bring it in the LS. Mukherjee has announced in Lok Sabha that we will bring it after consultations with all concerned. We will carry out some consultations," Bansal said.
While the Centre had committed to consider the demand for caste census in the last session, the failure to clinch the issue may see OBC chieftains stall Parliament.
The coming Bihar polls have led to aggression among OBC leaders and rivals Lalu Prasad and Sharad Yadav may adopt a tough posture in Parliament.
The monsoon session starting Monday will have 24 sittings over 33 days. There are key bills like civil nuclear liability bill which the Centre is keen to pass.
Following longstanding opposition from Trinamool Congress chief Mamata Banerjee, the twin bills of Land Acquisition Amendment and R&R have been officially taken off the priority. The RD ministry has not listed them for consideration, realising that government would be unable to move further on them.

The CBI is likely to take the custody of junior Gujarat home minister Amit Shah next week after examining two senior police officials including Geetha Johri, who was part of the Supreme Court-appointed Special Investigation Team probing the 2002 communal riots.
Union Human Resource Minister Kapil Sibal on Sunday said the Congress has nothing to do with the CBI naming former Gujarat Home Minister Amit Shah as an accused in the Sohrabuddin Sheikh fake encounter case.
"Congress has not made Shah an accused, it is the CBI which has chargsheeted the former Gujarat minister. CBI has made Shah an accused so he should follow the legal course and tell the court whatever he has to say," Sibal told reporters.
46-year-old Shah, has been slapped charges of murder and kidnapping in the fake encounter killing of alleged gangster Sohrabuddin Sheikh and his wife Kauser Bi in 2005, He resigned as Gujarat Home Minister on Saturday.
On BJP giving clean chit to Shah, the HRD Minister said every leader in the party was doing so.
"But the issue is whether the court would give him a clean chit," he said.
On BJP's allegation that chargesheet against Shah was already prepared, Sibal said "We are in the government, but we dont know anything about it. They (BJP) are outside the government and must be knowing more than us," he quipped.
"If Shah wants he should challenge the case against him in the court, if he wants he can apply for an anticipatory bail for the second time. It's upto him," he added.
"I dont want to indulge into this. CBI is the agency which issued summons, filed the chargesheet and made Shah and accused," Sibal said.
Sources in the investigating agency said that Shah, who was arrested in Gandhinagar on Sunday after he surrendered, needs to be confronted with some people who were being examined by the CBI in connection with the Sohrabuddin Sheikh fake encounter case.
A close aide of Chief Minister Narendra Modi, 46-year -old Shah on Saturday resigned as Minister of State for Home. Modi said Shah was "innocent" and a law-abiding citizen and charged that a pick-and-choose approach was being pursued against Gujarat.
Modi said CBI was being used as a political weapon to settle political scores.
They said the agency would be examining 53-year-old Johri, a 1982 batch IPS officer, and record her statement besides that of former Ahmedabad Police Commissioner O P Mathur, who retired last year on March 31, 2009. Some more police officials and individuals would also be examined by the CBI.
The sources said that after examining them and some others, the CBI would take the custody Shah, who has been sent to Sabarmati jail in Ahmedabad till August seven, for a thorough interrogation.
They said that he would also be confronted with some of the police officials already in custody after taking the permission from courts.
Shah has been charged under IPC Sections 302 (murder), 120 B (conspiracy), 341 (wrongful restraint), 342 (wrongful confinement), 364, 365 and 368 (all related to kidnapping), 384 (extortion) and 201 (disappearance of evidence).
Shah claimed that he was innocent and said that charges against him were "fabricated, politically motivated and were on the instruction of Congress government" and demanded that his entire questioning by the CBI be video-graphed.

Police were put on high alert at airports and railway stations on Saturday as the CBI launched a manhunt for Amit Shah who went underground after sending his boss, Gujarat chief minister Narendra Modi, his resignation as junior home minister.
The CBI deployed eight teams to nab the absconding ex-minister and issued a "Look Out" notice to ensure he doesn't flee the country, sources said.
Shah, who faces arrest after being charged with murder and extortion in the Sohrabuddin Sheikh fake encounter case, has ducked CBI sleuths for three days running and refused to respond to summons to appear for questioning in Ahmedabad.
Modi, in New Delhi for a CMs' meet, had said his junior minister sent his resignation to his Gandhinagar residence. "I came to know about the resignation when I landed in Delhi. On (my) return, I will complete formalities," he told reporters.
Asked if Shah's resignation amounted to an admission of guilt, Modi said he was fulfilling a Constitutional obligation. "Amitbhai is innocent. He is a law-abiding citizen and would fight the issue legally. I am confident that judiciary would provide him justice," Modi said of the man described as his closest aide.
Officials said raids were being conducted at various hideouts to nab Shah. Sources said the 46-year-old BJP leader was possibly in hiding in the hope that a high court judge would, on Monday, reject Friday's dismissal of his anticipatory bail plea by the special CBI Court.
The 2,000-page CBI chargesheet says Shah had entrusted the task of eliminating Sohrabuddin, an alleged gangster, to IPS officers DG Vanzara, Rajkumar Pandian and Abhay Chudasama. Sohrabuddin was killed in an encounter near Ahmedabad on November 26, 2005. Later, Shah allegedly ordered elimination of Sohrabuddin's wife, Kauserbi, described as a witness to her husband's slaying.
As Shah filed an anticipatory bail plea, the CBI filed a chargesheet against 15 people including Shah. The chargesheet names Shah as a key accused along with Vanzara, Rajkumar Pandian, M N Dinesh and Abhay Chudasama.
Apart from Shah, two other accused in the 2005 case Yashpal Chudasama and Ajay Patel too are wanted by the CBI and are reportedly in hiding. "All three are key accused in the fake encounter case and we are searching for them," said a senior CBI officer who is heading the probe.
Investigators also found that Shah brought to bear pressure on some of the officers to suspend the inquiry and also took away the papers under the guise of scrutiny. It is learnt that Shah directed G C Raigar, additional director general of police, CID (crime & railways) to provide him with the list of witnesses, both police and private, who are yet to be contacted by the CID (crime) for recording their statement in the enquiry. "Such directions from the minister of state for home go beyond the scope of his office," said a senior CBI officer.

Housewives, prostitutes, beggars clubbed in Census; SC upset
TNN, Jul 24, 2010, 12.42am ISTNEW DELHI: The Supreme Court has frowned upon the clubbing of `housewives' with prostitutes, beggars and prisoners under the economically non-productive' category in the Census, saying this betrayed the "totally insensitive" and "callous" approach of statutory authorities.
The stinging observation came from Justice A K Ganguly, who along with Justice G S Singhvi, agreed to increase the compensation awarded to a man whose wife had died in an accident.
"This bias is shockingly prevalent in the work of Census. In the Census of 2001, it appears that those who are doing household duties like cooking, cleaning of utensils, looking after children, fetching water, collecting firewood have been categorized as non-workers and equated with beggars, prostitutes and prisoners who, according to Census, are not engaged in economically productive work," Justice Ganguly said.
Surprisingly, the description of home-makers as part of the non-productive category had so far gone unnoticed. This clubbing flies in the face of the recognition that household chores performed by homemakers is of considerable economic value. In fact, there is a demand to compute the value of services provided by home-makers. There is also increasing recognition of the unquantifiable service women provide by raising children.
The SC frowned upon the low compensation awarded to the family of Renu after her death in a road accident, on the ground that as a housewife, she had no income. The Bench felt that the time had come for Parliament to realize the invaluable service rendered by housewives and amend the Motor Vehicle Act to give them their due.
Both judges agreed that the compensation paid by a tribunal, Rs 2.4 lakh, to Arun Aggarwal for the death of his wife Renu was too low as under Motor Vehicle Act provisions, the family was entitled to Rs 6 lakh.
The Allahabad HC had upheld the tribunal's award and the family then moved the apex court.
Terming the work of housewives as invaluable for the family, the Bench said, "The gratuitous services rendered by wife with true love and affection to the children and her husband and managing the household affairs cannot be equated with the services rendered by others.
"A wife/mother does not work by the clock. She is in constant attendance of the family throughout the day and night unless she is employed and is required to attend the employer's work for particular hours. She takes care of all the requirements of husband and children including cooking of food, washing of clothes, etc. She teaches small children and provides invaluable guidance to them for their future life," the Bench said.
It asked National Insurance Company to pay Rs 6 lakh compensation to Agarwal's family, with 6% interest. The insurance company will also have to pay Agarwal an additional Rs 50,000 towards legal costs.
Cong launches padayatra against BJP govt in K'taka
Bangalore Amid sounds of bugles, beating of dums, bursting of crackers and slogan chanting – "Bellary Bacchao and BJP Hatao" -- opposition Congress on Sunday launched its campaign against two-year-old BJP government in Karnataka with its Bangalore to Bellary padayatra protesting against illegal mining and its administrative failures.Veteran Congress leaders K Sriramulu and K H Ranganath, putting aside their old-age and ill-health, inaugurated the 320-km padayatra at the Freedom Park here in the presence of a well attended gathering of partymen.
Sriramulu, who was a minister in the late D Devaraj Urs ministry and credited with launching a battle against hotel owners for charging higher rates for food items served to customers and fixed prices for every eatables, symbolically handed over a handful of soil to KPCC President R V Deshpande urging upon the party to save "Karnataka from BJP rule".
The ceremony was in tune with Congress's campaign "walk for saving the state".
Former minister K H Ranganath handed over a sapling to opposition Congress leader Siddaramaiah, who is leading the "oust BJP" agitation to take up the task for protecting resources of the state, in the backdrop of Congress stir accusing Chief Minister B S Yeddyurappa government of its "failure" to check "loot of resources".
The principle opposition party, to ensure that its movement against saffron party government enjoyed the support of cross section of people and shorn of political barriers, roped in freedom fighters like H S Doreswamy, Jnanapeetha awardee U R Ananthamurthy, noted writer Baragur Ramachandrappa, B T Lalitha Naik, Prof Ravivarma Kumar and C S Dwarakanath, former chairman of Backward Classes Commission.
Doreswamy and Anantmurthy slammed the BJP rule and Sriramulu charged the government of focussing its attention towards mobilising resources to fund elections.
"The administration has gone astray. There is a need to bring it on track", Anantamurthy said.
Senior Congres leader Oscar Fernandes said "the padayatra is meant to send message to the people about misrule of the BJP government".
The Lokayukta probe had brought forward the issue of irregularity in mining and the Chief Minister himself has admitted to illegal mining in the state and demanded the government to act.
Siddaramaiah charged that government betrayed people and allowed illegal mining and illegal export of iron ore.
"Yeddyurappa himself conceeded that during his regime 1.5 crore tons of iron was illegally exported", he said, and declared the padayatra was not for "political gains, but to awaken the people about the misrule by BJP government, which should quit".
Motamma, Congress leader in the Upper House, urged partymen to maintain discipline and cooperate in making the padayatra a success.
Deshpande said the padayatra will culminate with a rally in Bellary on August 9, coinciding with Quit India Movement day and the message would be "quit BJP from Karnataka. Quit Corruption and Quit mis-rule of BJP".
Former Chief Ministers N Dharam Singh and S Bangarappa and several senior leaders were present during the inaugural function.
Tricolour baloons were released to the air to mark the beginning of the padayatra. The venue had several banners with slogans against mining magnets and Bellary ministers – G Janardhana Reddy, G Karunakara Reddy and B Sreeramulu.
More than 400 police personnel have been providing security cover to the padayatra in the wake of Siddaramaiah petitioning Governor H R Bhardwaj apprehending trouble from ruling party workers.
Even as the party was preparing for the padayatra, one of the senior leader Ram Bhat collapsed and was rushed to a hospital.
The party had made arrangements for supply of vegetarian food to the participants enroute the Padayatra. A medical team with ambulance is accompanying the padayatra, Congress sources said.

Stage set for stormy monsoon session

The Opposition and even some allies of the government are united on the price crisis which they say has been aggravated by the fuel price hike.
So, they want a discussion ending with a vote which could be embarrassing for the govt.

But there's more.
LK Advani has said the government's Pakistan policy is in shambles and the BJP has accused Foreign Minister SM Krishna of insulting the Home Secretary by not defending him on Pakistani soil.
The main Opposition party will demand a new deal for Bhopal victims and ask who in the 1984 Congress government allowed Warren Anderson to get away.
But the BJP will launch an offensive on what it calls the misuse of CBI because of the Amit Shah case. But the Opposition is divided on this, Mulayam Singh Yadav who too faces CBI cases, decided to stay mum.
And the Left who too says CBI is a political tool, refused to give BJP any reason to cheer.
"We agree about politicisation of CBI but do not agree in the case of the Gujarat minister," said Gurudas Dasgupta.
"The government brought this CBI issue to divide the Opposition," said Sushma Swaraj, Leader of Opposition in Lok Sabha.
In fact, the Left would target the BJP government in Karnataka for protecting those allegedly involved in illegal mining, the killing of an RTI activist in Gujarat and the recent evidence of saffron terror links.
On its part, the government says it's ready to discuss all issues.
"We are ready for any discussion but under what rule is something the Speaker will decide," said Prithviraj Chavan, Congress leader.
High food prices and the recent fuel hike are the only issues where the Opposition seems to be united. Otherwise, everybody has their own political agenda and a divided Opposition is good news to the government.

Sources said BJP and NDA leaders are in touch with other opposition parties to put up a united fight against the government in Parliament on issues like price rise, Bhopal gas tragedy and fleeing of UCC CEO Warren Anderson, Civil Liability for Nuclear Damages Bill, economic blockade of Manipur and the situation in Kashmir.
"We believe the entire opposition will join hands to grill the government and put them in the dock," Ahluwalia said.
BJP Deputy Leader in Lok Sabha Gopinath Munde said the opposition was united during the national strike against price rise on July 5 and this unity would continue.
Increase in prices of petroleum products would be also be an issue, he said.
However, there are apprehensions within BJP that the party may have to fight alone on the issue of "misuse of CBI" by the government.

their entire career by making false allegations, non-existing allegations which are going to be examined by the Supreme Court?" Congress spokesman Abhishek Singhvi told reporters in New Delhi countering the BJP's charges.
"The CBI is not foolish or idiotic to face the wrath of the Supreme Court by filing a false case," he said adding the BJP leader was trying to "fool the country" by claiming that he was being arrested under false allegations.
"Charge sheet is not made overnight. Charge sheet is a collection of evidence... Here, in over five-six months of investigation the CBI has got enough evidence against Amit Shah," Singhvi said.
He claimed there have been attempts to delay the course of law and said, "The law will take its own course. There have been attempts to delay that course and obstruct it."
Another Congress spokesman Shakeel Ahmed said after Shah, Chief Minister Narendra Modi should be prepared to face some "uncomfortable" questions in the case.
He claimed the BJP was "nervous" with the developments in the Supreme Court-monitored probe in the case and was using pressure tactics to block the probe.
"Shah was only a Minister of State for Home. The transfers of many IPS officers in the state were made by Narendra Modi. It is our understanding that these uncomfortable questions will be asked... Modi will have to answer them," Ahmed said.
"BJP is nervous and afraid that the investigation may go beyond Amit Shah and, hence, are using pressure tactics to block further investigation into the case," Ahmed claimed.
The CBI on Sunday arrested Shah in the sensational case when he appeared before the agency for questioning in Ahmedabad after evading CBI for four days.
Ahmed said law will take its own course in the matter and added "it is unfortunate that the BJP was trying to defend a cold blooded murder (of Sohrabuddin)."
The Congress spokesman said Shah had no option but to appear before the CBI as there was no possibility of any court granting him anticipatory bail in the case.

In an action-packed day, the former Gujarat Minister of State for Home, Amit Shah, presented himself before the Central Bureau of Investigation, was promptly arrested, produced in the court, sent to 14-day judicial custody and lodged in the Sabarmati central jail.
Everything from his dramatic appearance before the media to his being lodged in jail happened in quick succession and completed within four hours, with the CBI refusing either to question him or seek his remand for questioning later. As the CBI did not seek his remand, Mr. Shah, who held the Jail portfolio till he resigned on Saturday, was sent to judicial custody by the special CBI court and by 4 p.m. was inside the jail.
Appearing before the media at the BJP headquarter in Ahmedabad, Mr. Shah said he would directly go to the CBI office in Gandhinagar in response to its summons and "answer their questions."
As soon as he made the announcement, there was a flurry of activity here. Top CBI officials, headed by DIG P. Kandaswamy, who was investigating the case of Sohrabuddin fake encounter and murder of his wife Kausarbi, rushed to the office and the entire old Secretariat building was cordoned off by the police.
But by the time Mr. Shah, accompanied by some senior BJP leaders, reached the CBI office about a couple of hours later, he was not even allowed to enter the second floor office of the CBI. At the staircase itself he was stopped by Mr. Kandaswamy and other CBI officials and told that he was being taken to the court.
A shocked Mr. Shah wanted to know about questioning him but the CBI officials told him they did not intend to go through any such session. "I have come here on my own and am at your disposal, if you want me to take to court, it is fine with me," he said.
There was no word of any formal arrest. In less than two minutes, he was back in the car and taken back to Ahmedabad to be produced before the court. He was taken to the Maninagar residence of Special CBI Judge A. Y. Dave, in whose court the CBI filed the charge sheet on Friday. Yet another shock awaited Mr. Shah and all those present. The CBI did not press for his remand and instead wanted him to be sent to 14- day judicial custody, which was accepted by the judge and ordered accordingly. From there, he was taken to the jail.

With the former Gujarat Minister of State for Home Amit Shah in judicial custody in the Sohrabuddin Sheikh fake encounter case, the Central Bureau of Investigation (CBI) is now focussing its efforts on sewing up the loose ends of its probe and defending itself as allegations over its ``misuse'' fly thick and fast.
The CBI will now further examine the senior police officials, chargesheeted in the case, as well as some high ranking Gujarat police officers who have come under the cloud of suspicion for their role in the Sohrabuddin Sheikh fake encounter case. After this, informed sources said, the CBI by next week will seek police custody of Mr. Shah and confront him with the statements of the police officers and other evidence gathered by the CBI during its probe.
A rattled opposition Bharatiya Janata Party (BJP), fuming over arrest of Mr. Shah, considered close to Gujarat Chief Minister Narendra Modi, is sure to keep the issue alive in Parliament which begins its Monsoon session on Monday.
Even as the BJP leaders raise their pitch in attacking the CBI and its alleged ``misuse'' by the ruling party at the Centre, they would do well to remember that such charges against the premier investigating agency have been levelled in the past from time to time.
A former Director of the CBI who did not wish to be quoted was of the view that being a Home Minister of a State, Amit Shah, should have responded to the summons and appeared before the agency. He felt that BJP was ``unfairly criticising'' the CBI which has a right to call any body for further probe if it was in possession of some material facts.
``These were summons under Section 161 of the CrPC and was only a fact finding exercise. The minister should have given his version and explanation failing which the agency filed a chargesheet before the court. Mr. Shah should have gracefully cooperated with the agency which took up investigation on the directions of the Supreme Court. The court even rejected his anticipatory bail ,'' the former CBI chief said. He pointed out that even Gujarat Chief Minister Narendra Modi had appeared earlier this year before the Supreme Court-appointed and monitored Special Investigation Team (SIT) which is probing the 2002 anti-Muslim riots in Gujarat.
He reminded that it was the same BJP which had appreciated the role of the CBI in cracking the murder case of former Gujarat Home Minister Haren Pandya in 2003. The agency had at that time faced almost similar allegations from Vithalbhai, father of Haren Pandya, who had accused the Chief Minister Narendra Modi of being behind the murder of his son. An embittered Vithalbhai had even contested elections against BJP stalwart L. K. Advani and lost.
About seven years ago, CBI faced similar allegation by the Congress and others during the NDA regime when they slammed the ruling coalition for ``misusing the CBI'' in getting conspiracy charges dropped against the then Deputy Prime Minister L. K. Advani and others in the Babri Masjid demolition case.
In July 2003, the Opposition had wanted a debate in the Rajya Sabha on the alleged ``misuse of the CBI'' and Congress leader Pranab Mukherjee had moved the motion in the Rajya Sabha on the misuse of the CBI to subvert the process of law in the Babri Masjid demolition case.
CPI (M) leader in the Rajya Sabha Nilotpal Basu had pointed out that Babri Masjid demolition case was the one wherein the ```accused and the prosecution are one and the same''' and hence there was a conflict of interest.
It was during the NDA regime that an acting CBI Director was not confirmed and transferred out in January 1999 because he had dared to order raids on Reliance Industries Limited and CBI sleuths had reached the top floor apartment of RIL chief Dhirubhai Ambani.
However, in Gujarat which was shaken by the anti-Muslim riots in 2002, the CBI investigated the Bilkis Bano case and taken it to logical conclusion. On another front, the agency is still grappling with some of the 1984 anti-Sikh riots cases. Clearly, everything is not right with the administration of the criminal justice system and those from the political class and those with deep pockets manage to subvert the system and escape the process of law.
A report of the Parliamentary Standing Committee way back in 2000 wanted the Government to ``take measures to infuse professionalism in the working of the CBI.''
``If it is impartial and independent, the CBI will be stronger than the FBI. If not, it can be worse than Delhi Police,'' a former Union Minister who was also a member of the Standing Committee on Home Affairs, had remarked then. Over the past decade, the image and reputation of the CBI as an independent and impartial investigating agency has come under a shadow. In cases with political ramifications, the CBI has faltered and often taken up the probe on the directions of the Court. And where it has shown courage, like the Sohrabuddin fake encounter case, its motives are sought to be questioned by the BJP as its Gujarat leaders have started to feel the heat of the probe.
Speaking privately, serving and retired CBI officials, admit that political bosses asked it to take up cases that had little substance and cited the example of Jain Hawala case where the agency implicated a number of politicians. The Bofors case, Fodder Scam, JMM Bribery scandal and Babri Masjid demolition case are among those where CBI had been woken up from slumber either by the judiciary or media.

For five years the Narendra Modi government has failed to act on a recommendation by its own police department that a CBI probe be conducted into allegations that Amit Shah — who resigned on Saturday as Minister of State for Home — helped convicted stock market scamster Ketan Parekh in the Madhavpura Bank case after receiving a hefty bribe from him.
On August 1, 2005, Kuldeep Sharma, Additional Director-General of Police, CID, sent a 3-page report to Sudhir Mankad, Chief Secretary, Gujarat government, recommending a CBI inquiry into the bribe allegation after establishing there was prima facie evidence of wrongdoing. The report was not acted on and Sharma was quickly shunted out of the CID and put to pasture. Today, he is serving as Managing Director of the Gujarat Sheep and Wool Development Corporation (GSWDC).
The inquiry by the CID in Gujarat was initiated after an Ahmedabad resident, Hasmukh Shah, filed a written complaint alleging that Mr. Parekh paid a bribe of Rs. 2.5 crore to Amit Shah to help keep him out of jail.
Accused by the CBI in 2001 of cheating the Madhavpura Bank in Gandhinagar of Rs. 1,030 crore, Mr. Parekh was arrested and bailed out on the condition that he deposit Rs. 380 crore in the bank within three years. In 2003, the bank filed a Special Leave Petition (criminal) No. 1701/2003 in the Supreme Court pleading for cancellation of bail to Parekh.
In its report, the CID notes that Amit Shah, who was a director of the bank, held a meeting on August 31, 2004 with the DGP and other police and bank officials in which he "directed … that Ketan Parekh had not paid back Rs. 380 crores to the bank [within three years] and thus his bail was liable to be cancelled."
But in the first week of October 2004, the CID says a "political broker" named Girish Dani allegedly organised a meeting between Mr. Shah and Mr. Parekh. Soon after that, as per the Supreme Court's records, the SLP relating to cancellation of Mr. Parekh's bail was "disposed of" as the SLP was withdrawn by the bank.
The result was Mr. Parekh remained out of jail with no threat of cancellation of bail by the Supreme Court.
In its report, the CID said Ketan Parekh "had flown to Ahmedabad on 1st October 2004 and remained present [in the city]." Citing details of phone calls placed between Mr. Dani, Mr. Parekh and Mr. Shah, the CID report notes that "in this way … the persons alleged in the application had remained in contact with one another. And the time of taking of bribe is corroborated."
Noting that in the August 31, 2004 meeting, Mr. Shah, as Home Minister and director, Madhavpura Bank, decided that Mr. Parekh's bail must be cancelled, the CID said, "thereafter, the decision to prematurely withdraw the SLP for cancellation of bail before the [Rs. 380 crore] was paid back could not be taken by another officer."
The CID report said "Amit Shah [holds] an important position in the government and therefore there should be no cause left for suspicion about his conduct." Accordingly, it recommended the CBI be asked to probe the matter as the Central agency was already handling the larger Madhavpura Bank collapse case. But the Gujarat government chose not to take any action.
Bank still not revived
Leader of the Opposition in the Gujarat Assembly Arjun Modhwadia told The Hindu over the telephone on Saturday: "The Madhavpura Bank scandal was a Rs. 1,200-crore scam. Thousands of depositors who had more than Rs. 1 lakh as deposits in the bank have not yet got back their money. The bank has not yet been revived despite a revival package from the Reserve Bank. About 75 smaller cooperative banks which had large deposits with Madhavpura Bank were bankrupted."He demanded that even at this late stage this matter should be thoroughly investigated by the CBI along with the ongoing investigations into the murders of Sohrabuddin Sheikh, his wife Kauserbi and friend Tulsi Prajapati. "The main issue is why did Narendra Modi deliberately bury the CID report? If Mr. Shah is innocent, why shy away from a CBI probe that could establish his innocence?"
Senior BJP leader Arun Jaitley, who held a press conference on Friday criticising the ongoing CBI probe into Mr. Shah, was Mr. Parekh's lawyer in the case relating to the bank scam. Although Mr. Parekh got a light sentence in 2008, he has mostly remained out of jail.
Soon after he submitted his report to Chief Secretary Mankad — with copies sent to the Home Secretary and the Director-General of Police — Kuldeep Sharma of the CID was transferred out as Additional Director-General of Police (Training) where he served for 3 years. Then, after a short posting in the United Nations, he was kept without a post for several months before being posted to the GSWDC in November last year.

Disgraced Shah re-appears, arrested, jailed
Ahmedabad: On the run for three days, Gujarat's disgraced former minister Amit Shah was sent to 14-day judicial custody Sunday over an alleged Islamist's murder, hours after he made a dramatic appearance before the media and surrendered to the Central Bureau of Investigation.
The drama lasted just about five hours from the time Shah walked into the BJP office in Ahmedabad at 11.35 am and angrily denied the charges that he was involved in the 2005 killing of Sohrabuddin Sheikh, an alleged Lakshar-e-Taiba activist. After making a detailed defence of his case and answering a flurry of questions from journalists, the close aide to Chief Minister Narendra Modi drove to the CBI camp office in the state capital Gandhinagar, about 35 km away, accompanied by a large contingent of supporters.
Once the CBI formally arrested him, the process lasting only a few minutes, he was driven back to Ahmedabad where he was taken to the house of CBI judge AY Dave. Dave ordered Shah's judicial custody for 14 days as a large number of BJP activists ringed his house shouting slogans hailing the man who quit as minister Saturday amid a hunt for him.
The CBI, which surprisingly did not demand for Shah's remand after having summoned him earlier to question him, said it would take his custody if and when required. Sunday's developments marked a new turn in the case of Sohrabuddin Sheikh that has led to the arrest and jailing of 15 police officers including three from the Indian Police Service.
All of them are accused of conspiring to kill the man in cold blood. His wife has since disappeared, and the chargesheet against them says that she was murdered and her body burnt to destroy evidence. Shah's arrest has seriously strained relations between the BJP and the Congress-led government, with the BJP accusing the latter of using the CBI to target opposition parties.
The BJP also charged the Congress with "vote-bank politics" - an euphemism to mean the Congress was trying to woo Muslims, India's largest minority. Earlier Sunday, Gujarat BJP president RC Fardu was addressing a press conference at his office when a confident looking Shah suddenly walked in, stunning many of his colleagues and the media alike.
Accused of ordering the killing of Sheikh in a staged gun battle near Ahmedabad in November 2005, Shah insisted: "The accusations against me are fabricated, politically motivated and framed on the behest of the Congress government." Shah explained that he ignored the summons to appear in the CBI office Thursday and Friday because he was convinced the 3,000-strong chargesheet against him had been prepared in advance and his questioning was to be a sham.
He said he did not fear arrest. "I have full faith in the judiciary and want to say that this is a conspiracy and misuse of power by the Congress to come in power in Gujarat." Shah had sought anticipatory bail Friday but the plea was rejected by the court. Shah insisted that Rajasthan resident Sohrabuddin was a terrorist, pointing out that the Gujarat Police seized 46 AK-47s, 100 grenades and 100,000 ammunition from a well in his house.
He said while there has been 1,700 "encounters" -- suspected fake gun battles -- all over India, only those which took place in Gujarat were now being investigated. The Congress hit back, accusing the BJP of making Shah a scapegoat because his interrogation would lead to Chief Minister Modi.

Saffron terror

The phrase "saffron terror" is a neologism which entered public debate in India following the 29 September 2008 western India bombings.[1].

It was in the aftermath of the September 29 bomb blast in the predominantly Muslim town of Malegaon in Maharashtra that these terms came to be used widely.[2]
The term has been criticized as a "myth"[3] and as a tool for political posturing toward the Muslim minority[4][5][6]. It has been claimed by observers that the Intelligence Bureau and the Central Bureau of Investigation have been leaking statements to the media to promote the agenda of the Indian National Congress[7][8]. BJP's former President Rajnath Singh has denounced such claims as "vilification of Hindu saints and army officers in the name of Hindu terrorism".[9]
Former Madhya Pradesh Chief Minister Digvijay Singh had been raising the issue of "Hindutva terrorism" at least since October 2008 when he wrote about it to the Prime Minister Manmohan Singh,[10] statements that earned criticism from the Bharatiya Janata Party and a show-cause notice from the Election Commission of India[11].
In late 2008, Indian police arrested members of a Hindu radical cell allegedly involved in an attack Malegaon which killed 7 Muslims.[12] For incidents like these, Saffron terror has been used synonymously with "Anti-Muslim terrorism" or "Anti-Muslim reprisals"[13]

Bomb blasts in India which have allegedly been perpetrated by Hindu extremist organisations include 2006 Malegaon blasts, Mecca Masjid bombing (Hyderabad), Ajmer Sharif Dargah Blast and the 2007 Samjhauta Express bombings.[15][16][17][18][19]It was in the aftermath of the September 29 bomb blast in the predominantly Muslim town of Malegaon in Maharashtra that the terms Saffron Terror and Hindutva Terror came to be used widely in various medias.[20] However, the accused parties confessed to police on narco-analysis that they conspired with Muslim groups for the blasts.[21]
Three men accused of the 2006 Malegaon bombings, including Lt Col Shrikant Purohit of the India army, have been described as representing Hindu terrorism.[22] Purohit was also accused of being involved in the 2007 Samjhauta Express bombings until the role of Pakistani terrorist Asif Zamani was unearthed.[23][24].
Members of Abhinav Bharat have recently been alleged to have been involved in a plot to kill Rashtriya Swayamsevak Sangh President Mohan Bhagwat[25].
