Court rejects anticipatory bail plea of Amit Shah
The anticipatory bail plea of Gujarat minister Amit Shah, who did not turn up before the CBI for questioning in the Sohrabuddin Sheikh fake encounter case, was rejected by a special court.Shah is a close aide of Gujarat Chief Minister Narendra Modi.
CBI Special Court judge G K Upadhaya rejected Shah's application on technical grounds saying it did not mention under what section of IPC he had been made an accused.
Shah had earlier applied for anticipatory bail through his lawyer Mitesh Amin.
The minister of state for home, who had been asked by CBI to present himself before it by 1 pm today, failed to appear before the agency for questioning despite being summoned twice.
Instead his lawyer turned up at the CBI office in Gandhinagar demanding more time and a questionnaire. However, both his demands were rejected.

The conversation at the lunch table, had the BJP chosen to attend, may have challenged the host's famous diplomatic skills. In the last 48 hours, the CBI has moved with high velocity in Ahmedabad, filing a 30,000 page chargesheet against Shah, a minister and close aide of BJP Chief Minister Narendra Modi.
On Thursday, Shah was served a notice to meet the CBI by 1 pm. But he has not been an easy man to pin down this week. He has not been seen at his office, and skipped a cabinet meeting. When he was a no-show on Thursday afternoon, the CBI issued a second summon, giving him a deadline of 1 pm on Friday. Shah surfaced only in the form of a statement faxed to the press - he declared his innocence, and said that by giving him little or no time to respond to its notice, the CBI was acting "with malice." The Congress responded at its own press conference in the evening. The BJP was attacked both for its poor manners in skipping lunch, and in suggesting that the Congress is misusing the CBI to settle political scores. "A party that calls itself a responsible Opposition leader is fielding senior leaders to influence and subvert an ongoing Supreme Court-initiated investigation. It is indefensible and unheard of. BJP is scaling new heights of improper conduct. First, it was the Gujarat Home Minister running scared....not available, avoiding interrogation. Now perhaps the Gujarat Home Minister's mentor is equally scared and appears to have pressurized senior BJP leaders to prevent an ongoing investigation. It is unprecedented that a press conference be held on such an issue," pronounced Abhishek Manu Singhvi, spokesperson for the Congress. The PM's lunch, at his residence, he stressed was to discuss the agenda for the next Parliament session which begins soon.
The BJP says it decided on Thursday to decline the PM's invite for lunch. On Friday morning, senior leader LK Advani called Finance Minister Pranab Mukherjee.
By Friday evening, the mood in the BJP was sombre. Amit Shah was formally charged with murder at 6 pm, the party worries that the CBI is getting uncomfortably close to one of its biggest strengths, the Gujarat Chief Minister.
There's also the fact that the Congress will now have the upper hand in the monsoon session of Parliament which begins shortly. Till the Shah fiasco, the BJP had plenty of issues to target the government with - price rise, the aggressive stand taken by Pakistan after the talks with India last week. On these issues, the BJP would have been joined by other major opposition parties. But once again, the stain of communalism means that the BJP will find itself eating alone.

In a big blow to the BJP government in Gujarat, junior Home Minister Amit Shah, a close aide of Chief Minister Narendra Modi, was today charged with murder by CBI in the Sohrabuddin Sheikh fake encounter case and may face arrest after he was denied anticipatory bail. Shah, who has not been seen in public for several days and skipped Cabinet meetings and office, also failed to appear before the CBI earlier in the day for questioning for the second time in two days following summons issued twice, the deadline for which expired at 1 PM. Shah''s anticipatory bail plea shortly after he failed to show up before the CBI was rejected by Special CBI court judge G K Upadhaya, heightening the possibility of his arrest.
CBI also sent teams to the office and residences of the senior BJP leader in Gandhinagar and Ahmedabad and recorded statements of Shah''s staff but could not locate him. The probe agency tightened the noose around Shah, who has been named as an accused along with 14 others including some IPS officers in the chargesheet filed today in the special CBI court, on a day of fast paced developments.
Shah has been listed as accused number 13 and the chargesheet notes he has not been arrested. A CBI statement said the 15 accused were booked in the fake encounter of Sohrabuddin and for brutually killing his wife Kausarbi.
The CBI probe was spread over five states--Gujarat, Rajasthan, Madhya Pradesh, Andhra Pradesh and Maharashtra. About the summons to Shah, the statement said " he did not appear and hence chargesheet was filed without his examination.
" Besides the murder charge, the other charges against all the 15 accused included criminal conspiracy, wrongful confinement, kidnapping and abducting to murder, extortion and destruction of evidence under various IPC sections. The CBI is conducting a fresh probe into the November 26, 2005 encounter at the behest of the Supreme Court after questions were raised on the investigations by the Guajrat police.
Sheikh, an alleged gangster, was killed in an alleged fake encounter by Gujarat Police. The accused included IPS officers Abhay Chudasama, D B Vanzara, Dinesh M N and Rajkumar Pandian and eight other policemen.
All of them are under arrest. "Yes, we have sent teams," CBI sources said but avoided a direct reply when asked whether teams have been sent to arrest Shah.
In an attempt to avoid being questioned face to face by CBI officials, Shah earlier in the day sought more time to appear before the probe agency and sent his lawyer to its office here but his plea was turned down by it. Shah''s lawyer Mitish Amin said a request was made to the agency to request for more time and consider the option of handing a questionnaire to the Minister to respond to their questions.
However, CBI has turned down the request to give a questionnaire, Amin said. "They do not think that they need to give a questionnaire to us," Amin told reporters after coming out of CBI office.
Earlier, before going inside the CBI office, Amin had said, "The way he (Shah) has got the summon and he was asked to come for deposition, we feel that the time was too short". "We will ask the CBI to give the questionnaire as the incident is very old," he said.
"We are willing to cooperate but the time given to Shah was less. The way he has got the summons and was asked to come for deposition, we feel that the time was too less," Amin said.

Prime Minister Manmohan Singh's lunch for top BJP leaders on Friday ahead of the Monsoon Session of Parliament was called off after they expressed their inability to attend it.
PMO sources said that BJP leader L K Advani, Leader of Opposition in the Lok Sabha Sushma Swaraj and Leader of Opposition in the Rajya Sabha Arun Jaitley were invited for the lunch.
This morning they rang up to say they would not be able to attend the lunch, the sources said.
Meanwhile, the top BJP leaders held a strategy session at the residence of Advani in the wake of CBI summons to Gujarat Home Minister Amit Shah in the Sohrabuddin Sheikh fake encounter case.
All the three leaders are attending the meeting.
"The Indian economy is growing fast and from the presentUSD 1.2 trillion, it is expected to become a USD 5-trillion economy very soon," Folmsbee, said without specifying a particular time frame while addressing management students at G S College of Commerce in Nagpur.
The Consul General, who was in the city today for a seminar on 'Indo-US relations' also emphasised on the need for both countries to focus on vital issues like energy crisis, technology transfer, climate change, higher education and small as well as medium enterprises.
On the higher education scenario, particularly at the University level, Folmsbee said many US varsities were in the process of setting up their establishments in the country with Columbia University already establishing its institution in Mumbai.
The Prime Minister's economic think-tank today projected foreign investment in Indian capital markets to fall to USD 25 billion this fiscal from USD 32 billion in the previous year, even as it expected India to remain a lucrative destination for capital inflows.
Meanwhile, Gujarat Home Minister Amit Shah failed to keep his date with the Central Bureau of Investigation (CBI) on Friday in connection with the 2005 Sohrabuddin fake encounter case.
Shah's lawyer asked the CBI for more time and more details of what sort of questions the minister is likely to face.
According to sources, this is a strategic move to avoid direct questioning by the CBI.
"During 2010-11, there will be portfolio capital inflows of USD 25 billion, down from USD 32 billion in the previous fiscal," the Prime Minister's Economic Advisory Council Chairman C Rangarajan said while releasing the Economic Outlook 2010-11 report.
Rangarajan attributed the estimated decline in FII inflows to robust inflows in the previous year, after these investors withdrew money from Indian capital markets in large sums due to the global financial crisis.
However, portfolio investment in the next fiscal will again rise to 35 billion dollars, the PMEAC said.
Rangarajan said amid uncertainty in the western world, India remains an attractive destination for capital inflows, with the country's economic growth expected to be 8.5 per cent this fiscal and 9 per cent in the next financial year.
This will lead to rise in foreign direct investment (FDI) to USD 50 billion this fiscal from USD 31.7 billion in the previous fiscal. This will further increase to USD 55 billion in 2011-12.
FDI is supposed to be longer term investment by foreign investors, while portfolio investment is generally expected to be volatile.
The higher FDI inflows, along with larger inflows through external commercial borrowings and other debts, would more than make up for the decline in portfolio investment this fiscal.
As such, the total foreign inflows have been pegged at USD 73 billion this fiscal from USD 53.6 billion in 2009-10, which would further increase to USD 91 billion in 2011-12.
The strong capital inflows will ensure that the current account deficit (CAD), which swelled to USD 13 billion in January-March, would be managed comfortably. CAD refers to the deficit in external merchandise and services trade, besides investment income flows.
After covering for current account deficit, foreign capital inflows will add USD 30.9 billion to forex reserves this fiscal from USD 13.4 billion last fiscal. In the next fiscal, forex reserves will go up further by USD 39.8 billion through capital inflows.
"This (capital flows) would be adequate to finance the large current account deficit in the two years and leave a modest USD 31 and USD 40 billion (2.0 and 2.4 per cent of GDP) to be absorbed in the foreign exchange reserves," it added.
The panel expects the current account deficit to be 2.7 per cent of the GDP this fiscal.

A rejoinder: Terrorists and their apologists; India Is Another Israel

Imtiaz Alam, editor of South Asian Journal, in his over-enthusiasm, has projected India as the peace-loving nation – by implication a great proponent of 'Ahinsa' and 'non-violence', and that it is the perfect 'model' in South Asia, as all its neighbors are at peace with it, except Pakistan, which is notorious, brutish and nourishes hatred and antipathy against it and is perpetually engaged in acts of terrorism in Indian Held Kashmir (IHK) and several other on-going insurgencies. The article appears, as if it was an Indian writer, quite proficient in art of propaganda and has used "card-stacking technique" of projecting only the positive elements and completely ignoring the dark realities that constitute the major truth.I would say that silence could be the best answer to the 'grandiose' ideas he has of the 'Indian society.' With respect to the plight of the Muslims in India, I would expect the writer to read the book (if not read already),'The Passive Voice' by K.L. Gauba. He was a Muslim Congressite and against Pakistan's creation, who migrated to India after the partition. This book though written a bit earlier, exhaustively covered the sad plight of the Muslims, as to how they were being discriminated against for employment in civil services, including police besides the armed forces. I distinctly remember that he mentioned about one Muslim scholar, a PhD from Banaras Hindu University who was serving as dispatch rider in one of the civil departments in Delhi. What has happened consequently is even more agonizing. I will not go into the recent surveys, suffice it to say that their plight is even lower than that of Dalits. Asra Nomani, one of the most liberated Muslim women and exceedingly pro-western, in her write-up has depicted the miserable plight of Indian Muslims, who are at the bottom of social hierarchy.
In one of the surveys in 1980's, there were around 10,000 castes In India. Barun Mitra has written in an article India gone backward on castes. He is the director of liberty Institute – a think-tank in New Delhi and his article was published in India (reproduced by daily Nation, Pakistan, dated May 20, 2010). He writes: "Bhimrao, Ramji, Ambedkar, who chaired the committee that drafted Indian Constitution, was forbidden to touch water pots – as he was from a lower caste. Barely 40 years ago in New Delhi, it was not uncommon to find Brahman teachers, refusing to eat or drink if they were served by lower castes."
I shall narrate one instance of one of my own students at Rajshahi University, Department of Psychology (former East Pakistan), who after the emergence of Bangladesh had gone to India for his doctorate in the University of Allahabad. When he had visited Lahore for a conference, he met me with incredible love and affection. When I asked him as to what were his experiences in India, he said, "one of the very shocking one was that, when I had submitted my thesis for the approval to the Professor (my supervisor), there was some errors to be corrected. He offered his pen, but to his bewilderment, the full Professor of the University refused taking pen from a Muslim as it would pollute him." So the 'myth of India' which was so arduously created through the Indian media during the days when Bangladesh had not come into being, I thought that myth was eroded from his mind. There were many other 'experiences' which did not match with the ground realities. I am not touching much about the massacre of Muslims in Gujrat. How were they chopped off like carrots and radish? It is indeed very painful to recall the Ayodhiya episode of demolishing the historical Muslims mosque. Besides Muslims, Dalits, even Christians were not spared. How a Pope along with his family members were burnt alive inside the car at Orissa. Several other incidents of raping of Christian nuns and their killing, have come to light.
Over five lac soldiers in the IHK are not playing kabaddi? The atrocities being committed on their part are the worst instances of crime against humanity. If some radical Muslims reacted to such mega killings of over 80,000, the so called liberals tend to dub them as "terrorists", completely forgetting that 'state terrorism', which is at the root of 'radicalism', and essentially reactive in nature. Every self-respecting citizen has a right to defend his freedom. Not to do it, is servility, which is repugnant to the adherents of Islamic faith. They will die rather than surrender. This is exactly what Afghan resistance is about. They may be fanatics, fundamentalists, whatever, but give them the credit that they served as iron force against the contemporary Super Powers, former Soviet Union and now the USA, the empire builders. Invasion of countries like Iraq and Afghanistan are blatant acts of aggression. Killing of millions of Muslims in Palestine, Kashmir, Afghanistan and Iraq are nothing but crimes against humanity, if justice at all prevailed in the World Order.
If Kashmir issue were resolved Pakistani society would emerge as a paradise of peace. It has no extra territorial ambitions as India has. No doubt, there are differences among the Islamic faith just as there are so many denominations in Protestant faith, leaving alone the broad division between the Catholics and the Protestants. Allah has never designed the world for a monolithic order. The dignity of diversity is to be preserved. The miscreants, who are committing acts of terrorism, are essentially trying to fan divisions between Muslims. This is an age old strategy of balkanizing Muslims and atomizing them into as many splinter groups as possible. This is to break their unity. The terrorists are fully equipped with sophisticated weapons, which our police force does not possess. Where from are they coming? Who is funding them? These are the questions to be resolved through a well deliberated counter-terrorism strategy achieved through a broad consensus among the political parties.
Ironically, a 'construct' of 'conspiracy' has been created as a propaganda gimmick, in order to discredit any hypothesis/idea which is likely to be proven factual. It is a strategy of camouflaging facts and realities. There is thus a 'big conspiracy' against the so called 'conspiracy theories.' It is much easier to dismiss a reality by simply saying: "Ah! It is one of those 'conspiracy theories.' The terrorists, who are rampant in Pakistan, are not 'Taliban'. Pakistani Taliban or Punjabi Taliban are some of the semantic manipulations to defame Pakistan as if it were an abode of radicals, fanatics and 'terrorists.'. India on the other hand is free from such menace. That there are fissiparous trends in 17 or more Indian states is very shrewdly concealed. What about the Naxellites? They are overly active in quite a number of states, and that they are gaining in strength. India is finding it difficult to contain them. Were Indian forces not involved in fanning Tamil separatism in Sri Lanka?
Pakistan's radicalism is a post 9/11 phenomenon. The society, otherwise was relatively quite peaceful, adhering to the middle –of-the-road approach to Islamic ideology. Unfortunately, General Ziaul Haq in order to perpetuate his hold, produced radical forces to fight against the former Soviet Union. USA patronized them and when the Red Army had left Afghanistan, USA quite callously abandoned the freedom fighters. If a national government comprising representatives of Pakhtuns, Tajiks, Uzbeks and other minorities would have been formed, Afghanistan would not have been in the state of chaos as it is . The fault is entirely of USA, which covertly wanted it to be fragmented through warlordism.
The "terrorists", operating in Pakistan are no a 'monolithic entity. These are those who during the Soviet war were radicalized by the inept policy of Ziaul Haq and later on the reactions against Pervez Musharraf's very naively conceived policy of pleasing the US government by propounding the so called 'enlightened moderation', what actually meant, was to sheepishly adopt the western values, not realizing that Muslims could be very modern, yet they maintain the core values of their faith, which gives them their real 'identity' and respect among the comity of nations.
Now about the "Strategic Depth', which is a straight forward concept to achieve attitudinal harmony between Pakistan, Iran and Afghanistan, as very natural regional allies. A well deliberated geopolitical strategy has to be conceived creating mutual trust and harmony so that under conditions of peace, these countries reinforce each other's prosperity through trade and cooperation and under crises, they act similarly as EU countries do. If any of the countries in EU, is attacked by an adversary, "it would be taken as if it were an attack on EU", that is collectively they would protect each other. Why should it be a taboo for the Muslim countries, that they should not forge a 'cohesive mutual paradigm of inter-existence.'? "Strategic Depth is never a narrow concept of "physical depth", but a depth of security in all its dimensions. It is based on trust and a firm commitment to honour the dignity and identity of each other. No amount of propaganda can deter these countries to ultimately converge on a collective paradigm, which provides 'strategic security.' Too much voice is being raised against a legitimate concept – 'Strategic Depth' – as some one rightly said: "The higher the voice, the smaller the intellect."

The tiny Kurmi jati OBC leader, Nitish Kumar, has been getting raving reviews in even foreign media about his "great development" efforts — of course after he buttered the Brahmins who started loving the OBC leader only after joining hands with their own Brahmana Jati Party (BJP).
Heartland of Budhism: But false media reports painting a rosy picture will not please the oppressed 90% of Bihar — perhaps the country's most backward state.
Once the heartland of Budhism, the ruthless upper castes crushed the backbone of the SC/ST/BCs for having fought Budhism. But after they failed to save Budhism, they enbloc became Muslims to continue their fight. The fight is continuing because the war against Brahminism is never ending.
The latest game played by Nitish Kumar is to woo the state's massive 17% Muslim who have totally deserted him.
Lalu cheats Bahujans: The oppressed Bahujans of Bihar once found a liberator in Lalu Prasad Yadav. We too met him in Patna, when as Chief Minister he was thrown into jail, to offer our support. But once the Yadav leader started flirting with the serpent, the oppressed Bahujans deserted him and he fell from grace.
Bihar continues to be one of the poorest states of India but blessed with a fertile soil, plentiful Ganga water, and every input. But Biharis are today fleeing to Calcutta, Bombay and lately Bangalore. A micro-minority of upper castes — Brahmins, Thakurs, Bhumihars — are ruthlessly ruling Bihar. Strangely, Baniyas in Bihar are backward.
Narendra Modi a liability: Narendra Modi, Gujarat Chief Minister, whose visit to Bihar provoked the current Bihar turmoil. Modi a Ganchi, an oil-crushing OBC fellow, is a liability to the party itself outside Gujarat. The Teli with hardly any caste strength did a magic in Gujart by hinduising (enslaving) Dalits and Triblas and using them to kill Muslims in the famous Gujarat Genocide -2002. With the solid support of the Dalits and Tribals, he crushed Muslims to please the Gujarat's powerful ruling castes — Brahmins, Banias and Patels — whom he made powerless. But this caste experiment cannot be launched in Bihar.
The Brahminical upper castes are using Nitish to outwit the populous Muslims and Yadavas but he cannot conduct this experiment as his own caste is a poor minority. Brahminical media gave him a big media build-up but one single rain washed out all the paint on his face.
Irshadul Haque adds from Patna: The present political game, being played by Nitish Kumar (Kurmi) and his political ally, the BJP, is nothing but a pressure tactic. After four and half years in power, Nitish is now thinking that he is the champion of Bihar politics and that only he can mobilize the masses. The "political turmoil" created by him is a part of his game plan. After the swabhiman rally of BJP in Patna, Nitish successfully tarnished BJP. He said BJP tried to malign his "secular figure" by publishing a photograph of Nitish holding his hand with Gujarat Chief Minister Narendra Modi in local dailies. Consequently he also returned Rs. 5 crore, the aid given by the Modi Govt. during Kosi flood in Bihar in 2008. In fact, these are part of a game being played by JDU and BJP before the forthcoming assembly election in Oct.-Nov.2010.
Wooing Muslims: Nitish thinks this game can target both Lalu Prasad as well as the BJP. By returning the money to Narendra Modi and asking him not to come to Bihar for election campaign, Nitish wants to woo the 17% (1.4 crores) Muslims of Bihar. If the Muslims are polarized against Lalu then not only his party will enjoy Muslim support but also can get full majority. There are at least 60 out of the 243 Assembly seats where Muslims are dominant in Bihar. Secondly, he is also trying to put pressure on BJP that he can take credit for proving Narendra Modi as the Muslim Enemy No.1 as Lalu did it earlier by arresting L.K. Advani for his rath yatra (1990-91). After arresting Advani, Lalu got full support of Muslims.
Pasmanda gains upper hand: But it must be remembered that the year 2010 is not 1990. After 20 years political situation has changed. Now the Pasmanda Muslim movement has emerged as a major force in Bihar. Pasmanda Muslims are able to understand that "communalism" is not an issue on which they can be fooled. They know that (1) employment and (2) education are the main concern of Muslims. So Nitish is day -dreaming for his vote in the name of Narendra Modi.
Caste-based politics in Bihar has been a major factor in election. Nitish is a Kurmi which is only 3% of the population while Yadavs are 12%.
Upper caste revolt: In such a situation Nitish cannot do any magic in Bihar unless he gets support of the upper castes. But here also Nitish faces a revolt by two major upper castes. Bhumihar (3%) and Rajput also about 3% are against Nitish. His party state president, Lalan Singh, a Bhumihar leader, resigned from the party post and started Kisan Mahapanchayat against Nitish. Digvijay Singh, a Rajput and rebel JDU leader, successfully contested a parliamentary election as an independent and against Nitish. And the third dominant caste leader, Prabhunath Singh, also an MP, went against Nitish, At least six JD(U) MLAs joined Prabhunath Singh, a dominant muscleman of the Rajput caste.
Anti-Lalu wave: Only the 2.5% Brahmins have not taken their sword openly against him. But generally Brahmins have never been directly associated with the JDU. They have been the supporters of either BJP or the Congress. Nitish media management has been very strong. With Bhumihars against him, he might now lose the support of Bhumihar-dominated media.
Maha Dalit Commission: Nitish has never enjoyed the full support of any caste. He was riding on the anti-Lalu Yadav wave.
However, he has been trying to divide the Dalit votes. The 15% Dalit votes have been with Lalu and Ram Vilas (LJP), to some extent with the BSP and left wing local parties. But over the past four years, Nitish, by creating the "Maha Dalit Commission", has tried to polarize Dalit vote minus Paswan and Chamar castes. These two castes have almost 65% votes of total Dalit votes.
But it is too early to say that "Maha Dalits" will support him. This time, neither Lalu nor Ram Vilas are going to commit the same mistake as they did in 2005. In 2005 Assembly election, Lalu and Ram Vilas contested separately. But now at least Lalu has given this message by sending Ram Vilas Paswan to the Rajya Sabha that they are going to contest together. And hence this time Nitish will see rough weather in assembly election.

Bangalore: "Hindu terrorism" is becoming more serious and more widespread than "Muslim terrorism". But India's Brahminical media is silent on the more deadly terrorism by their own jatwalas.
In the book, Who Killed Karkare?, (Pharose Media, New Delhi, 2009, pp.340 Rs. 300, copies available with DV office), the respected Maharashtra police officer (retd) Mushrif has revealed everything including the hand of the very same "Hindu terrorists" in the famous Bombay blast.
But our Brahminical media is tight-lipped. India's topmost Brahminical daily TOI, (June 23, 2010), said both the Mecca (Hyderabad) Masjid and Malegaon blast (2008) are done by the same Hindu terrorists. It gave a list of 11 blasts in different parts of the country — all conducted by the very same Abhinav Bharat. Lt. Col. Prasad Srikant Purohit (37), a serving army officer, now in jail along with other top Chitpavan Brahmin leaders, is the brain behind — with full money and material support from the Israeli Jewish state.
Pune blast: DV disclosed that even the Pune German Bakery bomb explosion was done by the same gang (DV April 16, 2010: "Super RSS Abhinav Bharat behind Pune terrorist act").
But neither the Maharashtra Govt. nor the one in Delhi are ready to act against the killers of M.K. Gandhi. This killer gang may be a drop in the ocean of 1,300 million Indians but as they control the entire media and hence the public opinion, plus many within the political leadership, the govt. is not in a position to act tough — accept go on singing the same song of "Muslim terrorism".

Bangalore: "Hindu India" is guided and shaped by Brahminical thoughts, its reigning philosophy. M.K. Gandhi, the Gujarati Bania, hailed as the "Father of the nation" (not our nation) by the ruling upper castes (15%), finally died for Brahminism.
Such a "holy" country packed with "great brains", "world famous intellectuals" now finally admits that its education system, manufactured by the same brain, has utterly failed.
The Hindu, India's chief Brahminical daily (June 13, 2010) says top industrial bosses of India have asked the govt. to allow US universities to enter India. Why allow outsiders when our own "Brahmin brains" are the best in the world and have 150% monopoly on Indian education system from top to bottom?
No quality education in India: The Hindu report reveals that the Brahminical big brains have themselves admitted that they can't offer "quality education". That means India's education system has been a thorough failure. Our "Khatri Sick" PM is a great admirer of the Brahminical big brains. And he will be too glad to open the gate to US educational institutions headed by top Jews, all brothers of "Jews of India".
So apart from the financial sector, India will soon have collaboration with the Jews in the educational field also. That means India' dying 400-odd universities will finally die. One by one the Brahminical rulers of India are handing over the country to Jews.
Not even a shaving blade made in India: The boasting rulers shout about "India shining", jumping, world class standards but these fellows could not manufacture even the humble razor blade for shaving. We asked many top Brahminical bosses of industry to name the blade they use. They said Gillette which is a Western product.
Nothing is made in India except the humble but reliable bullock cart. Everything "foreign" is liked by our rulers — including the Scotch Whisky.
The secret behind allowing US educational institutions to enter India implies that the entire 85% of the Bahujan children will be neglected and the money diverted to equip the youth of he upper castes to exploit the rest.

India for 'mechanism' to stop misuse of US aid to Pak
India conveyed its serious concerns over the US military aid to Pakistan being misused against it and asked America to establish a 'monitoring mechanism' to ensure that this does not happen.
Defence Minister A K Antony during his meeting with US Joint Chiefs of Staff Committee Chairman Admiral Mike Mullen here also expressed his apprehensions that American arms aid was disproportionate to the war on terror for which it was meant, Defence Ministry sources said here.
Antony told the American Admiral that they should ensure that aid was used only for the purpose it was meant.
The Indian side conveyed its serious concerns over the aid to Pakistan being misused against it and asked the US to establish a "monitoring mechanism" to prevent it.
In a 45-minute meeting at South Block here, Mullen is said to have appraised the Indian Defence Minister about the American assessment of the security situation prevailing in Afghanistan and Pakistan.
"The US Admiral called on the Defence Minister here for a 45-minute meeting and discussed the security situation in South Asia and the Af-Pak scenario, and also its changing dynamics in great detail," the sources said.
Mullen also renewed US Defence Secretary Robert Gates' invitation to Antony to visit Washington, which was accepted.
Accordingly, Antony will be visiting the US in the last week of September this year, they said.
Earlier in the day, Mullen called on his Indian counterpart and IAF Chief Air Chief Marshal P V Naik. The meeting with the Air Chief was described as a courtesy call by IAF officials.
Azhar denies romancing Jwala Gutta
Former Indian skipper Mohammad Azharuddin today sought to scotch speculation of his romantic relationship with Jwala Gutta, saying the ace badminton doubles player is just a "good friend."
According to media reports, Azharuddin has been dating 26-year-old Jwala and is on the verge of filing for divorce from his wife of 14 years Sangeeta Bijlani within a week.
However, Azharuddin, a Congress MP from Moradabad, rubbished all such reports, terming them as baseless, fabricated and in bad taste.
"These reports are completely rubbish, baseless and are in bad taste. I am very hurt by all these. I know Jwala, she is a good friend of mine and to write such reports which are completely false and fabricated is disgusting," a livid Azharuddin said.
Azhar said these are motivated by people in the Badminton Association of India, who want to tarnish his image since he tried to contest for the presidential elections last month.
"These are planted stories and motivated by people, who are against me in the Badminton Association of India. I think they should look into their homes first before casting aspersions on others and make such allegations," he said.
"Jwala is a very good player and she is a great prospect for the country. She has been doing well and will win many medals for the country in future. So I just want to request everybody to just leave her alone and not get her into this cheap controversy," he added.
World number seven mixed doubles player Jwala is married to India's ace shuttler Chetan Anand, who is also the current national champion.
According to the media report, which quoted a source from the Andhra Pradesh Badminton Association, Jwala was seen many times with Azharuddin after her practice session at the Gachibowli stadium.
The 47-year-old cricketer was also spotted with Jwala during the Asian Badminton Championship in Delhi.
Azharuddin played 99 Tests and 334 ODIs for India and has two sons -- Asaduddin and Abbasuddin -- from his eight-year marriage to first wife Naureen.
After his divorce with Naureen, he married Bollywood actress Sangeeta Bijlani.
SC paves way for rape convict to join IAS
The Supreme Court today dismissed the petition of National Commission for Women challenging the Delhi High Court verdict reducing the life imprisonment of a rape convict to five and half years to pave the way for him to join the civil services.
A Bench comprising Justices H S Bedi and C K Prasad rejected the appeal of the NCW saying it had no locus standi (right to appear before a court) in the matter.
"Your prayer is for the enhancement of the sentence. There is no provision in the CrPC allowing persons other than the state, prosecutor or the kins of the victim to file an appeal under such circumstances. You have no locus standi in the case," the Bench said.
Additional Solicitor General Mohan Parasaran, appearing for Delhi government, said the prosecution was not making any appeal against the decision of the High Court.
"We do not prefer to file appeal in the matter," he submitted the before the Bench which refused to interfere with the High Court verdict.
"We are not inclined to interfere with the High Court decision," the Bench said while rejecting the submission of advocate Priya Hingorani that the apex court has inherent power to entertain the appeal.
The NCW had contended that the it was a case of serious crime of rape and the High Court has given untenable grounds for reducing the punishment of the convict.
The convict had cleared the civil services exams during his imprisonment.
Earlier, the apex court had issued a notice seeking response of the NCT government in January 2009.
When the counsel for the NCW tried to bring to the attention of the apex court that it had already issued a notice in the matter, the court said issuing of a notice by it does not debar it from examining the maintainability of appeal.
The High Court had reduced the sentence saying the convict has "redeemed" himself in jail.
Ashok Rai alias Amit, a tutor, was convicted on charge of raping his 21-year old student who had committed suicide after the incident.
However, his conduct that he studied in the jail and got selected in the Indian Administrative Services (IAS) was taken note of by the High Court which said the jail term already undergone by him would meet the ends of justice.
Though the High Court upheld the conviction for the charge of rape, it did not agree with the trial court holding the accused guilty for the offence abetment of suicide.

Court rejects Shah's bail, arrest imminent
In a dramatic development, the CBI has filed a 30,000 page chargesheet in the Sohrabuddin case against Gujarat minister Amit Shah and senior police officials including the a DIG. Shah has been charged for murder, abduction and destruction of evidence and also criminal conspiracy. The Court has rejected his anticipatory bail plea.
Amit Shah failed to show up before the investigating agency for the second time today in connection with the Sohrabuddin Sheikh fake encounter case. However, instead of him, his lawyer Mitesh Amin turned up at the CBI office demanding more time and a questionnaire. But the investigating agency refused to oblige. This makes possibility of Amit shah's arrest imminent
This has resulted in an open war between the Congress and the BJP over Gujarat chief minister Narendra Modi's right hand man and Gujarat Home Minister Amit Shah.Earlier Sohrabuddin's lawyer Amreesh Patel has said that he is confident of Amit Shah will not get bail. He had expressed confidence that there is enough evidence to indict the minister. The lawyer said, "I don't think he will get bail. There is enough prima facie evidence against him. The media reports have also suggested that the police officers have said that the crime was done under the instructions of the MoS."
The story so far till today
Shah was given time till 1 PM today to appear before the CBI after second summons was sent to him yesterday when he did not respond to the first summons to show up before the agency.
Shah's lawyer Mitish Amin, who went to the CBI office here, said a request was made to the agency to request for more time and consider the option of handing a questionnaire to the Minister to respond to their questions.
However, CBI has turned down the request to give a questionnaire, Amin said. "They do not think that they need to give a questionnaire to us," Amin told reporters after coming out of CBI office. "Now, I will discuss this with him (Shah)," Amin said.
Asked what were the legal options available with him, Amin said, "There are many legal options available to Shah and one of them is anticipatory bail. But I will discuss the matter with my client and decide about the further course of action".
Earlier, before going inside the CBI office Amin had said, "The way he (Shah) has got the summon and he was asked to come for deposition, we feel that the time was too short". "We will ask the CBI to give the questionnaire as the incident is very old," Amin said.
"We are willing to cooperate but the time given to Shah was less. The way he has got the summons and was asked to come for deposition, we feel that the time was too less," Amin said.

Top BJP leaders on Friday refused Prime Minister Manmohan Singh's invitation for lunch ahead of the Monsoon session of Parliament, angry over the CBI summoning the Gujarat Home Minister Amit Shah in connection with the Sohrabuddin Sheikh encounter case.
Leader of the Opposition in the Lok Sabha Sushma Swaraj said they decided to boycott the Prime Minister's lunch in protest against the "misuse" of CBI to corner Shah.
PMO sources said that senior BJP leader L.K. Advani, Swaraj and Leader of the Opposition in the Rajya Sabha Arun Jaitley were invited for the lunch to discuss issues that may come up in the Parliament session.
Swaraj said Advani had raised the issue of "misuse" of the CBI with Finance Minister Pranab Mukherjee but government did not pay heed.

Reports indicate that the spokesperson and central committee member of Maoists, 'Azad' Cherukuri Rajkumar and zonal committee member Hemchandra Pandey were shot dead by the Andhra Pradesh Police in an alleged encounter in Adilabad district on July 2. Azad was picked up by the AP police in Nagpur three days prior to the fake encounter.
They were arrested from Nagpur, taken to the jungles of Adilabad and shot dead in cold blood.
The scandals in which the CBI is made to go slow:
Scams very often have a shelf life and often come with an expiry date. They are the darlings of the media, the fodder for news channels that are euphemistically called 24 hour talk shops and a politician's nightmare or delight depending on which side of the fence he is. Here are a few scams that came and went through the doors of the CBI:
Bofors: This scandal happened before the birth of the 24 hour talk shops. So, it was easy to bury the truth and also let one of the prime accused - Mr Q - to escape. Many accuse the CBI of putting up a weak case when it came to extraditing Q. Though he was detained in a couple of nations following a red corner notice, the CBI was least interested in getting him. Finally, the CBI recommended that the red corner notice be withdrawn.
Almost all the accused are dead. The Bofors story has been popping up in the media at regular intervals for over 20 years. It was Rajiv Gandhi who was in the eye of the Bofors storm. The rights and wrongs of the case are lost on the new generation, some of whom were born after the Swedish Radio first broke the story back in April 1987.
Bhopal Gas tragedy
Here too the CBI is accused of not putting in enough effort to get former CEO and chairman of Union Carbide Corporation Warren Anderson for the Bhopal gas tragedy that killed over 15,000 people .
But who allowed Anderson to flee? Here are some of them who betrayed the Bhopal gas victims and the collective conscience of India:
Suspect Number 1, Arjun Singh: He was the Chief Minister of Madhya Pradesh when the Bhopal gas tragedy happened on the night of 2-3 December, 1984. Unless he had given specific instructions, how could Anderson have got a plane to flee to Delhi and then to the US.
According to The Indian Express, on December 7, 1984, Anderson spent a few uncomfortable hours in the company's Research and Development Centre on the picturesque Shymla Hills near Bhopal. He had been arrested from the airport and taken there, four days after the world's worst industrial disaster.
"He was taken aback when we told him that he was under arrest," said Moti Singh who was then Bhopal Collector. He recalled how the Anderson landed at the airport casually with a gas mask in hand.
But a couple of hours later, the state and Central governments went the extra mile to make him feel comfortable and arranged a bail of Rs 25,000.
According to Rajkumar Keswani, one of the first journalists to break the gas leakage story, it was Singh who allowed use of the government plane after receiving a call from Delhi.
Who called Arjun Singh from Delhi and gave instructions to go soft on Anderson? Moti Singh too says that there was a call from Delhi to free Anderson. Who was the mysterious caller? Rajiv Gandhi had become prime minister only weeks earlier following Indira Gandhi's assassination.
Once the message reached Arjun Singh, he rushed in and made sure that the authorities treated Anderson well and was released without delay. A magistrate was taken to the Union Carbide guest house, he was granted bail just four hours after his arrest and then he was taken in a police car to the airport where a state plane was waiting to take Anderson to Delhi.
Considering the haste and urgency with which Arjun Singh acted, it is obvious that the call from Delhi was from the highest authority - the Prime Minister's office. So, was it Rajiv Gandhi?
The CBI is silent on this.
The role of the CBI has never been above the water marks of controversy in the Bhopal gas case. BR Lall, the CBI officer investigating the case in 1995 when Narasimha Rao was the prime minister, has openly come out and claimed that it was the Ministry of External Affairs that had written to the CBI asking them not to pursue Anderson's extradition.
"It (note not to pursue Anderson's case) originated from External Affairs Ministry and then to it came to us. I don't know at what level the decision was taken," Lall claims
Though the claim has been denied by Lall's boss and the then CBI director K Vijay Rama Rao, the matter needs a second look as Lall claims that there was documentary evidence in this regard.
Mayawati is accused of corruption in the Rs 175 cr Taj Corridor scam. The CBI has registered a disproportionate assets case against her. The agency has told the Supreme Court that the charge sheet is ready against Mayawati in the case. Status: Hearing yet to be completed. Congress is treading a cautious path as Mayawati could turn the tables if the case is pursued with vigour.
The CBI has charged Mulayam Singh Yadav with amassing assets beyond his known sources of income. The CBI has conducted an enquiry against him on the directions of the Supreme Court. The CBI has filed a status report where a decision is pending on the CBI proceeding with its enquiry;
Lalu Prasad Yadav was accused of corruption in the Rs 990 crore charges of illegally withdrawing funds from the treasury against the account of the state's animal husbandry department. Known as the fodder scam, the CBI probed the case and the trial in underway. But there is no urgency in the case as Lalu is close to the Congress and is an ally of Sonia Gandhi in Bihar. Elections in Bihar are due next year and the Congress cannot afford to upset lalu. So, the case has been put into a slow motion. Fodder scam has the danger of slipping into the realms of a forgotten chapter.
-Some say this is the biggest scam, but nobody knows the amount involved. The BJP feels the spectrum scam under A Raja is the biggest one in India so far. The CBI has registered a corruption case on the recommendation of the Central Vigilance Commission in the allotment of 2-G spectrum, licences by the telecom ministry headed by A Raja.
It has alleged that Rs 20,000 crore worth of losses were caused to the government exchequer by this allotment. But the DMK, an ally of the ruling coalition at Delhi, has put pressures on the Congress and the case does not seem heading anywhere.
Only allegations seem to be flying thick and fast. Some say the scam could be as high as a whopping Rs 60,000 crore. Well, your guess is as good as mine; only Spectrum Raja can tell the exact figure. But, mind you, he is a politician and why should he let out the figures?
The CBI is also not interested in the Richie-rich of Indian politics. India has politicians who are so rich that their wealth could as well pass off as a major component of a State's budget figures.
The CBI is not `interested' in India's super-rich politicians involved in various scams:
-A Raja: Rs 20,000 crore
-Amrinder Singh: Rs 1500 crore
-Lalu P Yadav: Rs 990 crore
-Mulayam S Yadav: Rs 200 crore
-Mayawati: Rs 175 crore
-Prakash S Badal: Rs 78 crore
These are only estimates. The figures could run into a few more crores.

Police, protesters clash in Indian Kashmir

SRINAGAR, India — Security forces fired teargas at stone-throwing protesters in Indian Kashmir as fresh protests against Indian rule broke out Friday, police and witnesses said.
A major clash took place in the northern town of Kupwara, where hundreds of residents took to the streets in defiance of a strict curfew, prompting volleys of teargas shells and baton charges from police.
There were also sporadic clashes in Kashmir's main city Srinagar, and the northern towns of Palhalan and Baramulla.
Earlier, security forces had sealed off neighbourhoods in Srinagar with barbed wire.
"There is no curfew but strict restrictions are in force in some sensitive parts of Srinagar," police officer Pervez Ahmed said.
Muslim separatists had urged Kashmiris to march to a holy shrine for a protest rally, but the site was sealed off by police.
The Muslim-majority Kashmir Valley has been in turmoil since a 17-year-old student was killed on June 11 by a police tear-gas shell.
Since then, security forces have been accused of killing 16 more civilians -- mostly teenagers -- as they struggled to contain growing anti-India protests.
The region has been under curfew for most of the past six weeks, with a separatist-called strike adding to the disruption of normal life.
A two-decade insurgency by militants who oppose New Delhi's rule in Indian Kashmir has claimed more than 47,000 lives, according to an official count. Human rights groups say the toll is twice as high.

NEW DELHI — India and the United States signed an anti-terrorism pact on Friday, a day after Pentagon's top military officer warned extremists could try to stage fresh attacks on the South Asian country.
The India-US Counter Terrorism Cooperation Initiative aims to boost security ties between the two countries, including closer liaison between their commando and special forces, an Indian government statement said.
The agreement came a day after top US diplomatic and military officials warned of fresh attempts by militant groups to push nuclear-armed rivals India and Pakistan into a military conflict.
The chairman of the US Joint Chiefs of Staff, Admiral Mike Mullen, said he feared extremists would attempt another operation similar to the 2008 Mumbai attacks to goad India into armed retaliation against its neighbour.
India said the pact also aims to increase "exchanges between coast guards and the navy on maritime security" and establish procedures to undertake joint investigations.
Timothy Roemer, the US ambassador to India, who signed the agreement on behalf of Washington, said it would go a long way to strengthening cooperation between the two countries.
"Today, with the formal signing of the initiative, we take several significant steps forward against terrorism," Roemer told reporters.
"In the coming days and months there will be even closer information-sharing and collaborative efforts on issues ranging from bomb blast probe and major event security to mega-city policing, cyber and border security," he said.
The diplomat said the pact was forged on the sidelines of a state visit to the United States by Indian Prime Minister Manmohan Singh last November.
"President (Barack) Obama and the (Indian) prime minister have acknowledged the common threat that international terrorism poses to all people," Roemer added.
Signed in the form of a memorandum of understanding, the accord will also enhance cooperation in tracking money laundering and the financing of terrorism, the home ministry statement said.
India says the Mumbai assault, which left 166 people dead, was carried out by the Pakistan-based Lashkar-e-Taiba (LeT) militant group and abetted by "official agencies" in Pakistan.
US officials said they have pressed Pakistan to prosecute LeT extremists but have so far made little headway.
Mullen, on a two-day visit to India, said Thursday the rampage showed how a small group of extremists could have a "strategic impact" and push the countries towards a possible conflict.
The two countries in recent years have forged closer security bonds, spanning joint military exercises to hardware sales by the United States to the technology-starved Indian defence force, the world's fourth-largest.

Terming terrorism as the biggest challenge, the US today said it takes any terror attack in India very seriously. Satara (Maharashtra), July 23 (ANI): The right-wing Shiv Sena activists drained out thousands of litres of milk in Maharashtra's Satara city on Friday as a mark of protest against the State Government's decision to import processed milk powder in the region.
In a highly charged agitation, scores of Shiv Sena activists resorted to hooliganism and vandalism of sorts, as they disrupted local traffic by stopping milk tankers to empty their contents on the streets.
The locals said nearly fifty thousand litres of milk, worth millions, was drained out onto the streets.
Raising 'anti-government' slogans, the protestors alleged that Maharashtra Government's decision was hitting local dairy businesses, already reeling under the impact of the rising inflation.
"It is so shocking that 30,000 tonnes of milk powder are being imported by the Maharashtra Government, while milk is being procured at rupees five a litre. This move of the government has come as a big blow to the regional dairy and livestock owners. We oppose this injustice," said Shankar Godse, a Shiv Sena leader.
"The Shiv Sena, along with regional milk suppliers and cooperative federations, would boycott all dairy supplies to consumers if the State and Central Government did not take affirmative action by July 24," he added. (ANI)CWG on Punjab terrorists, ISI radar: intelligence report
The 2010 Commonwealth Games (CWG) to be held in New Delhi this October is on the radar of terrorists from Punjab and their supporters in other countries, including Pakistan's ISI, says an intelligence report of the Punjab Police.
Field police officials in Punjab have been alerted by the latest intelligence inputs that state: 'Sikh militant leaders based in Pakistan are under tremendous pressure from ISI (Inter-Services Intelligence) to carry out sabotage activities in India...and Sikh militant leaders were planning to undertake some militant actions, including bomb blasts, before the Commonwealth Games scheduled to be held in New Delhi in October 2010'.
The intelligence report, a copy of which is with IANS, has pointed out that '15 kg of RDX, sourced by Ranjit Singh Neeta (of Khalistan Zindabad Force), was smuggled into India from Pakistan for this purpose which was divided into three parts'.
'One part was to be delivered in Rajpura area (40 km from Chandigarh) which was later recovered by the police from Piara Singh of Ferozepur district, which was concealed in the house of one Surat Singh of village Lohra Nawab in Ferozepur, an associate of (militant) Balbir Singh Bhootna of KCF (Khalistan Commondo Force).'
Punjab Police sources told IANS that the second part of the RDX consignment was to be delivered to a person in the Nawanshehr/Balachaur area (80 km from Chandigarh) while the third part was to be delivered in neighbouring Haryana's Sirsa district.
The third part of the consignment could be meant for a militant strike against controversial Dera Sacha Sauda sect chief, Gurmeet Ram Rahim Singh, who is being targeted by Sikh militants after his run-in with the Sikh community in April-May 2007 over projecting himself on the lines of 10th Sikh guru, Gobind Singh.
The intelligence report states: 'Sikh militants living abroad were so desperate that they were planning to sneak into India.'
Those identified in the report include Balwinder Singh from Britain, Jassi (earlier residing in Italy and now based in France), Rana from the US who is close to US-based Satnam Singh Babbar. Rana is in touch with Sukhdev Singh, who sells hardline Sikh literature from a shop near the Golden Temple in Amritsar, and Pamma, who was involved in the killing of Rashtriya Sikh Sangat president Rulda Singh in Punjab last year.
'Reliable inputs indicated that even Ranjit Singh Neeta himself could enter India if the above mentioned four boys failed to carry out the desired tasks,' the intelligence report said.

Born in a middle class family in Vadnagar, a member of Rashtriya Swayamsevak Sangh since childhood, and an active politician since early in life having a masters degree in political science, Modi, along with Keshubhai Patel was seen as a hardliner early on and his coming to the fore in BJP led to a shakeup in the organization with Shankarsingh Vaghela leaving the party. In 1998, he was chosen by L K Advani to direct the election campaign in Gujarat as well as Himachal Pradesh. His aggressive and confident style was successful in the midst of failure to unite between Vaghela's RJP and Congress and the campaign culminated in a victory leading to Keshubhai becoming the chief minister in March, 1998.
Due to his successful direction of campaign in Gujarat and Himachal Pradesh, Modi, who was working at national level then, was promoted to become general secretary soon after.
He became Gujarat's Chief Minister in October 2001, promoted to the office at a time when his predecessor Keshubhai Patel had resigned, following the defeat of BJP in the by-elections.
He was re-elected in December 2002 as chief minister with 127 seats in the 182-member assembly. His term has been praised by leading industrialists[3][4] and religious leaders[5] for outstanding administration for turning Gujarat into an economic powerhouse and controlling terrorism. He has been criticised for alleged mismanagement of and complicity in the 2002 Gujarat violence, for which the United States government has instituted a ban on him traveling to that country.[6][7]
In July 2007 he became the longest serving Chief Minister in Gujarat's history when he had been in power for 2063 days continuously.[8]
He was elected again for a third term[9] on 23 December 2007 with an emphatic win in the state elections, which he had cast as a "referendum on his rule".[10][11] Modi became the first Chief Minister of any state to be questioned in a criminal complaint of mass murder after he and his administration were accused of aiding and abetting riots in one area in Ahmedabad.[12]
Some members of Corporate India consider him as a potent "future Prime Minister of India". These views were openly kept forward at the "Vibrant Gujarat Global Investors' Summit" (VGGIS) by Reliance ADAG chairman Anil Ambani, who called him "the next leader of India (Future Prime Minister)". Bharti Airtel chief Sunil Mittal, too, have openly acknowledged this view by stating that "if there is a CEO who can lead this country, it is Narendra Modi".[13]

Modi was born on 17 September 1950 to a middle class family in Vadnagar in Mehsana district of North Gujarat. During the Indo-Pak war in the mid sixties, even as a young boy, he volunteered to serve the soldiers in transit at railway stations. In 1967, he served the flood affected people of Gujarat. As a young man, he joined the Akhil Bharatiya Vidyarthi Parishad, a student organization and was involved in the anti-corruption Nav Nirmāṇ ("Reconstruction") Movement. After working as a full time organizer for the organization, he was later nominated as its representative in the Bharatiya Janata Party.[14] He started with Rashtriya Swayamsevak Sangh (RSS),a socio-cultural organization with a focus on social and cultural development of India.
He completed his schooling in Vadnagar. He holds the distinction of being a well-educated politician, having earned a masters graduate degree in Political Science from Gujarat University. He is known for being a poet and has published few book of poetry. He is a bachelor. He is the first and thus far, only, bachelor chief minister of Gujarat.

During his tenure with the RSS, Modi played several important roles on various occasions including the 1974 anti-corruption agitation and the harrowing 19-month (June 1975 to January 1977) long 'Emergency (India)',declared by the then Prime Minister Indira Gandhi, when the fundamental rights of Indian citizens were strangled. Modi kept the spirit of democracy alive by going underground for the entire period and fighting a spirited battle against the fascist ways of the then central government[citation needed]. Modi was a Pracharak in the RSS during his university years.[15] [16].
He entered mainstream politics in 1987 by joining the BJP[citation needed]. Just within a year, he was elevated to the level of General Secretary of the Gujarat unit. By that time he had already acquired a reputation for being a highly efficient organizer[citation needed]. He took up the challenging task of energizing the party cadres in right earnest. The party started gaining political mileage and formed a coalition government at the centre in April 1990. This partnership fell apart within a few months, but the BJP came to power with a two-thirds majority on its own in Gujarat in 1995. Since then, the BJP has been governing Gujarat.
Between 1988 and 1995, Modi was recognized as a master strategist who had successfully gained the necessary groundwork for making the Gujarat BJP the ruling party of the state[citation needed].
During this period, Modi was entrusted with the responsibility of organizing two crucial national events, the Somnath to Ayodhya Rath Yatra (a very long march) of L.K. Advani and a similar march from Kanyakumari (the southernmost part of India) to Kashmir in the North. The ascent of the BJP to power at New Delhi in 1998 has been attributed to these two highly successful events, substantially handled by Modi[citation needed].
In 1995, he was appointed the National Secretary of the party and given the charge of five major states in India – a rare distinction for a young leader[citation needed]. In 1998, he was promoted as the General Secretary (Organization), a post he held until October 2001, when he was chosen to be the Chief Minister of Gujarat, one of the most prosperous and progressive states of India.
During his stint at the national level, Modi was given the responsibility to oversee the affairs of several state level units, including the sensitive and crucial state of Jammu and Kashmir and the equally sensitive north-eastern states. He was responsible for revamping the party organization in several states[citation needed]. While working at the national level, Modi emerged as an important spokesman for the party and played a key role on several important occasions.

In October 2001, he was called upon by the party to lead the Government in Gujarat. When the Modi government was sworn in on 7 October 2001, the economy of Gujarat was reeling under the adverse effects of several natural calamities, including a massive earthquake in January 2001. However Modi, a master strategist, who was enriched by national and international exposure and experience, decided to take the bull by its horns.
He is believed to be a protégé of Lal Krishna Advani, who is a senior leader of the Bharatiya Janata Party himself. Advani has praised Modi on numerous occasions, referring to him as "a leader who, after being subjected to a malicious and prolonged campaign of vilification, has been able to impress even his critics with his determination, single-minded focus, integrity and a wide array of achievements in a relatively short time."[17]

Main article: 2001 Gujarat EarthquakeThe biggest challenge which he had to face, when he took over as the Chief Minster, was the reconstruction and rehabilitation of the areas affected by the massive Gujarat Earthquake of January 2001. Bhuj was a city of rubble and thousands of people were living in temporary shelters without any basic infrastructure. Today Bhuj is proof of how Modi has turned adversity into an opportunity for holistic development. In this critical situation, Modi is credited with starting immediate work to re-organize and stimulate the local economy.[18] Modi made an international record of restoration of 876618 houses in just 500 days. For Narendra Modi's outstanding contribution for disaster management and rehabilitation, on 16-10-2003 Gujarat govt got UN Sasakawa Award for outstanding work in the field of disaster management and risk reduction.
[edit] Gujarat violence
Main articles: 2002 Gujarat violence and Godhra Train BurningIn February 2002 violence broke out across the state claiming around 1000 lives. Independent estimates by human rights groups and NGOs place the figure higher to around 2000. The official estimate stated that 790 Muslims and 254 Hindus were killed, 223 people were reported missing and 2,500 were injured.[19] The root cause of riots was attributed to the Godhra Train Burning incident in which 58 Hindu Kar Sevaks were burnt alive by an alleged Muslim mob but it was never proven.[20][21] The Banerjee committee, set up by Railway Minister Lalu Prasad in September 2004, in its report submitted in 2005 had said the burning of S-6 coach of Sabarmati express on 27 February 2002 was an accident started by people cooking food in the railway car and said there was no Muslim involvement.[22][23] The Nanavati Commission however termed the Sabarmati express incident as a 'pre-planned conspiracy' and gave a clean chit to Mr. Modi[24]
[edit] Political fallout
As an aftermath of the riots, there were calls for Modi to resign from his position as chief minister of Gujarat. The opposition parties stalled the national parliament over the issue. Even Dravida Munnetra Kazhagam (DMK) and Telugu Desam Party (TDP), allies of the BJP, asked for Modi's resignation.[25][26] Modi submitted his resignation to the Governor and recommended the dissolution of the 10th Gujarat Legislative Assembly.[27][28] In the following state re-elections the BJP, led by Modi, won 127 seats in the 182-member assembly.
The United States revoked a visa for Modi the following year. He was cited for responsibility for violations of religious freedom under the International Religious Freedom Act of 1998.[29]
In April 2009, India's Supreme Court appointed a special team of investigators to look into the role Modi had played in the alleged anti-Muslim conspiracy.[7] The team was appointed in response to the complaint of Jakia Jafri, the widow of ex-Congress MP Ehsan Jafri, who was murdered in the riots.[30]

Modi's 2007 election campaign was marked with some passionate speeches reflecting his vision for Gujarat and his aggressive leadership. One such speech was given at Magrol in response of Sonia Gandhi's speech calling him a "merchant of death",[31] and referred to Sohrabuddin's killings. For this speech the Election Commission of India, a constitutional body governing election proceedings in India, cautioned Modi as it considered it as indulging in an activity which may aggravate existing differences between different communities. However, a similar procedure was not brought against Sonia Gandhi causing a lot of furore in Modi's supporters.[32]

Main article: Gujarat Development under Narendra ModiModi took charge of Gujarat when its economy was shrinking and the domestic growth was stagnant.[33] Faced with massive economic losses, he re-organised the government's administrative structure and embarked upon a massive cost-cutting exercise.[34] As a result of his elaborate efforts, Gujarat registered a GDP growth rate of over 10% during his first tenure. This was the highest growth rate among all the Indian states.[35]
As a Chief Minister, Modi concretely put to practice his envisaged Gujarat by means of various yojana.[36] This includes Panchamrut Yojana,[37][38][39] a five-pronged strategy for an integrated development of the state, Sujalam Sufalam, a scheme to create a grid of water resources in Gujarat in an innovative step towards water conservation and its appropriate utilization.
- Krishi Mahotsav – agricultural research labs for the land
- Chiranjeevi Yojana – to reduce infant mortality rate
- Matru Vandana – providing preventive and curative services under the Reproductive and Child Health Programme
- Beti Bachao – campaign to protect baby girls to improve sex ratio
- Jyotigram Yojana – to electrify every village
- Karmayogi Abhiyan – to educate and train government employee
- Kanya Kalavani Yojana – to encourage the education of girls
- Balbhog Yojana – for midday meal for students
As a result of these yojna's Gujarat became number one state in India in various perspective. Many scholar and India Inc leaders suggested that if Gujarat model is applied in all states in India, India can easily become a developed nation.
He also took the intiative to raise the controversial Narmada Dam's height above 100 metres. Modi went on to raise the dam's height to 121 metres even after being criticised by environment activists. Though large sections of farmers and other communities were unhappy with his policies, industries thrived during his regime and the condition of the infrastructure in the state improved. [40]
[edit] Position on terrorism
On 18 July 2006 Modi delivered a speech criticizing Indian Prime Minister Manmohan Singh "for his reluctance to revive anti-terror legislations" like the Prevention of Terrorism Act. He asked the Centre to empower states to invoke tougher laws in the wake of the blasts in Mumbai.[41] Quoting Modi:
" Terrorism is worse than a war. A terrorist has no rules. A terrorist decides when, how, where and whom to kill. India has lost more people in terror attacks than in its wars.[41] " Narendra Modi has frequently commented that if the BJP came to power at the Centre, they will honor the 2004 Supreme Court judgement to hang Afzal Guru.[42] Afzal was convicted of terrorism in the 2001 Indian Parliament attack in 2004 by the Supreme Court of India and is in Tihar Jail.[43]
During the November 2008 Mumbai attacks, on Thursday 27 November, Narendra Modi held a meeting to discuss waterfront security along the coastline.[44] At the conclusion of the meeting, it was decided that a number of steps be taken to improve security:
- Increase the number of police stations along the coast to 50 (from 10)
- Increase the number of police to 1500 from 250
- 30 modern high-speed surveillance boats (there are currently none)

Although the BJP narrowly managed to win majority of the seats in Gujrat, the loss of the Rajkot seat, after almost 20 years of control, was unexpected. Prominent politicians like Sharad Yadav commented that the BJP's projection of Modi as a future Prime Minister affected its performance in the 2009 Lok Sabha elections.[45] 'A confidential report, prepared by the BJP on the reasons for the party's humiliating defeat in the 2009 Lok Sabha election, has blamed Modi' among many Indian politicians and other factors'. Furthermore BJP criticism of Modi worries Gujarat leaders[46][47]

2002 Gujarat violence

(January 2009) The 2002 Gujarat violence describes the Godhra train burning and resulting communal riots between Hindus and Muslims. On 27 February 2002 at Godhra City in the state of Gujarat, the Sabarmati Express train was forcibly stopped and attacked by a large Muslim mob.[1] As a result, 59 Hindu passengers — mostly women, children and seniors returning from the holy city of Ayodhya — were burned alive. The attack prompted retaliatory massacres against Muslims on a large scale, in which 790 Muslims and 254 Hindus were killed. 223 more people were reported missing. [2][3] 523 places of worship were damaged: 298 dargahs, 205 mosques, 17 temples, and 3 churches. Muslim-owned businesses suffered the bulk of the damage. 61,000 Muslims and 10,000 Hindus fled their homes. Preventive arrests of 17,947 Hindus and 3,616 Muslims were made. In total 27,901 Hindus and 7,651 Muslims were arrested. Nearly 10,000 rounds of bullets were fired by the police, killing 93 Muslims and 77 Hindus.[4][5][6][7]
The nature of the events remains politically controversial in India. Some commentators have characterized the massacres of Muslims as a genocide in which the state was complicit,[8] while some government sources have countered that the Muslim dead were victims of mere "riots" or "disturbances".[9]

[hide][edit] Godhra train burning
Main article: Godhra train burningOn 27 February 2002, 58 Hindus, including 25 women and 15 children, were burnt alive in a railway coach by a mob[10] in the town of Godhra following an altercation between local Muslims and activists of the Vishva Hindu Parishad (Kar Sevaks) returning by the Sabarmathi express train from Ayodhya.[11] Initial media reports blamed the local Muslims for setting the coach on fire,[12] in what Gujarat chief minister Narendra Modi and the VHP leader Giriraj Kishore alleged was a "pre-planned" attack.[13][14] The New Nanavati Report states that the Attack on the "Kar Sevaks" on the train from Ayodhya was pre-planned, and exonerates Chief Minister Narendra Modi.[15] A previous report on the Godhra train burning, filed by Justice Banerjee, a more recent report filed by Justice Nanavati states that it was "pre-planned" by the mob. The Gujarat High Court ruling, as of 2006, has declared as illegal and unconstitutional, setting up of the Umesh Chandra Banerjee committee, which had concluded the fire started by accident. Gujarat High Court quashed the conclusions of the Banerjee Committee and declared its formation as a "colourful exercise," "illegal, unconstitutional, null and void," and its argument of accidental fire "opposed to the prima facie accepted facts on record."[16][17]
The Ahmedabad-based Forensic Science Laboratory (FSL), after conducting intensive tests, reported that it is impossible that inflammable liquid could have been poured from outside into the train compartment.[18] One of the reason it gave was that the height of the window of the coach was around 7 feet from the ground at the place and in the position it was not possible to throw any inflammable fluid inside from outside the coach from any bucket because by doing this, most of the fluid was getting thrown outside.[19] According to report, inflammable liquid was already present in the train compartment and fire started from inside.
However, in September 2008 the Godhra Commission confirmed that there was an attack by a mob.[1] Going further, the report claims that one Hassan Lalu had thrown burning objects into the train and 140 litres of petrol had been used to set the train on fire, adding that stones were thrown at passengers to stop them from fleeing.[20][21]
The bodies of those killed in the train were brought to Ahmedabad, where a procession was held,[22] a move seen as a major provocation for the ensuing communal violence.[23] The VHP issued a call for a state-wide strike on 28 February 2002, which was supported by the BJP.[24][25]
[edit] Post Godhra violence
151 towns and 993 villages[26] in fifteen to sixteen of the state's 25 districts were affected by the post-Godhra violence, which was particularly severe in about five or six districts. The violence raged largely between 28 February and 3 March, and after a drop, restarted on 15 March, continuing till mid June.[27] Northern and central Gujarat, as well as the north-eastern tribal belt which are closer to Godhra City, were the worst affected while Saurashtra and Kutch remained largely peaceful.[26]
[edit] Attacks on Muslims
Attacks by large Hindu mobs began in the districts of Ahmedabad, Vadodara, Saberkantha and, for the first time in its history, Gandhinagar on 28 February. Violence spread to the largely rural districts of Panchmahals, Mehsana, Kheda, Junagadh, Banaskantha, Patan, Anand and Narmada the next day. Over the next two days, Bharuch and Rajkot and later Surat were hit.[28]
The first incidents of attacks on the Muslim community started at Ahmedabad, where Hindus began throwing stones at and later burned a Muslim housing complex known as Gulburg Society, and then spread elsewhere.[29] The initial violence was believed to be instigated by unsubstantiated rumours, endorsed by a senior VHP leader, of Muslims having kidnapped three Hindu girls during the Godhra train attack.[29]
In Ahmedabad, the dargah of the Sufi saint-poet Wali Gujarati in Shahibaug and the 16th century Gumte Masjid mosque in Isanpur were destroyed. The Muhafiz Khan Masjid at Gheekanta was ransacked.[30] Police records list 298 dargahs, 205 mosques, 17 temples and three churches as damaged in the months of March and April.[31]
[edit] Attacks on Hindus
Attacks on Hindus by Muslim mobs in Danilimda, Modasa, Himmatnagar, Bharuch, Sindhi Market, Bhanderi Pole, and other localities in the city of Ahmedabad in Gujarat were perpetrated by Muslim mobs.[32] There was a significant loss of property.[33][34] Late in March, more than one thousand Hindus in Dariyapur and Kalupur, including 550 dalits, fled their homes to stay in makeshift shelters after being attacked by Muslims mobs.[35] According to the HRW report, over ten thousand Hindus were made homeless.[32]
Several Hindu residential areas, including Mahajan No Vaado, a fortified enclave in Muslim dominated Jamalpur, were targeted following calls for retaliation.
In the morning the mosques began announcing that Islam was in danger, that there was poison in the milk. This was used as a code word. The milk was meant to be Muslims & poison meant Hindus. The rioting lasted between 2:15 p.m. and 5:30 p.m.[32]
Residents were unable to go to work, fearing attacks. A Hindu temple in the area was destroyed. In Himmatnagar, a young man was killed when he went to a Muslim enclave on business.[32]
[edit] Toll
According to an official estimate, 1044 people were killed in the violence - 790 Muslims and 254 Hindus including those killed in the Godhra train fire. Another 223 people were reported missing, 2,548 injured, 919 women widowed and 606 children orphaned.[36]
Unofficial estimates put the death toll closer to 2000, with Muslims forming a high proportion of those killed.[37]
When missing people were declared dead after 7 years, total deaths went up from 1044 to 1,267.[38][39]
[edit] Security failure
By the evening of 28 February, curfews were imposed in twenty seven towns and cities.[40] By 25 March, thirty five towns were under curfew.[41] Police records show 21,563 preventive arrests were made by the end of April (17,947 of the arrested were listed as Hindus and 3,616 as Muslims) as well as 13,989 substantive arrests (9,954 Hindus and 4,035 Muslims).
The New York Times' Celia Dugger reported that witnesses were "dismayed by the lack of intervention from local police", who often "watched the events taking place and took no action against the attacks on Muslims and their property".[42] Human Rights Watch reported that in some cases members of the state police force led rioting mobs, "aiming and firing at every Muslim who got in the way", or instead of offering assistance "led the victims directly into the hands of their killers."[43] Calls for assistance to the police, fire brigades, and even ambulance services generally proved futile.[43]
By the end of April, police recorded 170 people as killed in police firing, of whom 93 were Muslims and 77 were Hindus.[31]
Hindu residents of Mahajan No Vaado, part of the Muslim dominated area of Jamalpur, told HRW that on 1 March, the police ignored phone calls and left them fend for themselves when a Muslim mob attacked.[32] Numerous calls by Hindus throughout the riots were reportedly ignored by the police.[32]
One thousand army troops were flown in by the evening of 1 March to restore order. Intelligence officials alleged that the deployment was deliberately delayed by the state and central governments.[44] On 3 May, former Punjab police chief K P S Gill was appointed as security adviser to the Chief Minister.[45]
The Gujarat government transferred several senior police officers who had taken active measures to contain and investigate violent attacks to administrative positions.[25][46][47]
RB Sreekumar, who served as Gujarat's intelligence chief during the riots, alleged that the state government issued "unconstitutional directives", with officials asking him to kill Muslims involved in rioting or disrupting a Hindu religious event. The Gujarat government denied the allegations, calling them "baseless" and instigated out of malice because Mr. Sreekumar was not promoted.[48]
Defending the Modi administration in the Rajya Sabha against charges of genocide, BJP spokesman V K Malhotra said that the official toll of 254 Hindus, killed mostly in police firing, indicates how the state authorities took effective steps to curb the violence.[49] BJP MP and journalist Balbir Punj disputed allegations of bias against Muslims by the BJP-run state government, pointing out that the majority of those arrested during and after the riots were Hindus.[50]
An unidentified pamphlet circulated to journalists in Gujarat in 2007 labelled Modi's government as anti-Hindu for arresting Vishwa Hindu Parishad (VHP) workers and Hindu activists involved in the riots.[51]
[edit] Role of government and police
The Gujarat state government was reprimanded immediately for failing to prevent the riots, but then increasingly for actively fomenting and participating in it, which was a far more serious charge. Critiques came repeatedly from the Supreme Court, and the upper house of the Indian parliament unanimously passed a resolution calling for federal intervention in Gujarat; a similar censure motion in the lower house was defeated by about 100 votes.[52]
The United States Department of State in its International Religious Freedom Report 2003 commented on the episode,[53] based on a report by USCIRF:
" India's National Human Rights Commission (NHRC), an official body, found evidence in the killings of premeditation by members of Hindu extremist groups; complicity by Gujarat state government officials; and police inaction in the midst of attacks on Muslims. The NHRC also noted "widespread reports and allegations of well-organized persons, armed with mobile telephones and addresses, singling out certain homes and properties for death and destruction in certain districts-sometimes within view of police stations and personnel," suggesting the attacks may have been planned in advance. Christians were also victims in Gujarat, and many churches were destroyed.[54] " In April 2002, retired supreme court justices V. R. Krishna Iyer and P. B. Sawant headed a citizen's panel to investigate the riots.[55] Their report includes testimony of the then Gujarat Bharatiya Janata Party (BJP) minister Haren Pandya (since murdered), who testified about an evening meeting convened by Narendra Modi the evening of the Godhra train burning. At this meeting, officials were instructed not to obstruct the Hindu rage following the incident.[56] The report also highlighted a second meeting, held in Lunawada village of Panchmahal district, attended by state ministers Ashok Bhatt, and Prabhatsinh Chauhan, and other BJP and RSS leaders, where "detailed plans were made on the use of kerosene and petrol for arson and other methods of killing."[57]
In 2003, A comment by G.T. Nanavati, who leads the official commission investigating the riots, that part of the evidence collected and reviewed till then did not indicate any serious lapse on the part of the government or police in Gujarat[58][59] was criticised as inappropriate by aid and reconciliation activists and other jurists.[60][61]
Organizations such as Human Rights Watch criticized the Indian government for failure to address the resulting humanitarian condition of people, the "overwhelming majority of them Muslim," who fled their homes for relief camps in the aftermath of the events; as well as the Gujarat state administration for engaging in a cover-up of the state's role in the massacres.[62] Many of the investigations and prosecution of those accused of violence during the riots have been opened for reinvestigation and prosecution.[63][64] The large-scale civil unrest has been generally been described as riots or inter-communal clashes.
In response to allegations of state involvement, Gujarat government spokesman, Bharat Pandya, told the BBC that the rioting was a spontaneous Hindu backlash fuelled by widespread anger against Muslims. He said "Hindus are frustrated over the role of Muslims in the on-going violence in Indian-administered Kashmir and other parts of India".[65]
The US Ambassador at Large for International Religious Freedom, John Hanford, expressing concern over religious intolerance in Indian politics, said that while the rioters may have been aided by state and local officials, he did not believe that the BJP-led central government was involved in inciting the riots.[66]
At the same time, about two hundred policemen lost their lives trying to control the violence in Gujarat.[67]
[edit] Criminal prosecutions
The Indian Supreme Court has been strongly critical of the state government's investigation and prosecution of those accused of violence during the riots, directing police to review about 2,000 of the 4,000 riot related cases that had been closed citing lack of evidence or leads.[63] Following this direction, police identified nearly 1,600 cases for reinvestigation, arrested 640 accused and launched investigations against 40 police officers for their failures.[64][68]
Human Rights Watch alleges [69] that state and law enforcement officials harass and intimidate[70] key witnesses, NGOs, social activists and lawyers who are fighting to seek justice for riot victims.
In its 2003 annual report, Amnesty International says, "the same police force that was accused of colluding with the attackers was put in charge of the investigations into the massacres, undermining the process of delivery of justice to the victims."[71]
The Best Bakery murder trial received wide attention after witnesses retracted testimony in court and all accused were acquitted. The Indian Supreme Court, acting on a petition by social activist Teesta Setalvad, ordered a retrial outside Gujarat in which nine accused were found guilty in 2006.[72] A key witness, Zaheera Sheikh, who repeatedly changed her testimony during the trials and the petition was found guilty of perjury.[73]
After a local court dismissed the case against her assailants, Bilkis Bano approached the National Human Rights Commission and petitioned the Supreme Court seeking a retrial. The Supreme Court granted the motion, directing the Central Bureau of Investigation to take over the investigation, transferring the case out of Gujarat and directing the central government to appoint the public prosecutor.[74][75] Charges were filed in a Mumbai court against nineteen people as well as six police officials and a government doctor over their role in the initial investigations.[76] In January 2008, eleven men were sentenced to life imprisonment for the rape and murders and a policeman was convicted of falsifying evidence.[77]
In 2005, the Vadodara fast track court acquitted 108 people accused of murdering two youths, during a mob attack on a group of displaced Muslims returning under police escort to their homes in Avdhootnagar. The court passed strictures against the police for failing to protect the people under their escort[78] and failing to identify the attackers they had witnessed.[79]
Nine people were convicted of killing a Hindu man and injuring another during group clashes in Danilimda, Ahmedabad on 12 April, while 25 others were acquitted.[80]
Eight people, including a VHP leader and a member of the BJP, were convicted for the murder of seven members of a family and the rape of two minor girls in the village of Eral in Panchmahal district.[81][82]
Fifty two people from Pavagadh and Dhikva villages in Panchmahal district were acquitted of rioting charges for lack of evidence.[83]
A stringent anti-terror law, the POTA, was used by the Gujarat government to charge 131 people in connection to the Godhra train fire, but not invoked in prosecuting any of the accused in the post-Godhra riots.[84][85] In 2005 the POTA Review Committee set up by central government to review the application of the law opined that the Godhra accused should not be tried under the provisions of POTA.[86]

On 6 March, the Gujarat government set up a commission of enquiry headed by retired High Court judge K.G. Shah to enquire into the Godhra train burning and the subsequent violence and submit a report in three months.[87] Following criticism from victims' organisations, activists and political parties over Shah's alleged proximity to the BJP, on 22 May, the government reconstituted the commission, appointing retired Supreme Court Justice G.T. Nanavati to lead the commission.[88][89] In 2008, the Nanavati commission came out largely in favour of the Gujarat government's aspect. Nanavati's evidence hinged on the acquisition of 140 litres of petrol hours before the arrival of the train and the storage of the said petrol at the alleged key conspirator's, Razzak Kurkur, guest house. This was further corroborated by forensic evidence showing fuel was poured on the train compartment before being burnt. The alleged mastermind was said to be the cleric Maulvi Husain Haji Ibrahim Umarji and a dismissed Central Reserve Police Force officer named Nanumiyan, from Assam, who had instigated the Muslim crowds. Furthermore, two Kashmiris, Gulamnabi and Ali Mohammed, were in the same guesthouse for a fortnight prior to the event speaking about the Kashmir liberation movement.[1]
The Communist Party of India (Marxist) and the Indian National Congress party both came out railing against the exoneration of the Gujarat government by the commission citing the timing of the report (with general elections months away) as evident of unfairness. Congress spokesperson Veerappa Moily commented at the strange absolvement of the Gujarat government for complacency for the carnage. He also said the report reinforced communal prejudices.[90]
[edit] National Human Rights Commission
In its Proceedings of 1 April 2002, the Commission had set out its Preliminary Comments and Recommendations on the situation and sent a Confidential Report of the team of the Commission that visited Gujarat from 19–22 March 2002 to Gujarat government and Central Home Ministry. The Gujarat government in its reply did not provide its response to the Confidential report. Therefore, the Commission was compelled to release the confidential report in its entirety[91] and observed that nothing in the reports received in response "rebuts the presumption that the Modi administration failed in its duty to protect the rights of the people of Gujarat" by not exercising its jurisdiction over non-state players that may cause or facilitate the violation of human rights.
It further observed that "the violence in the State, which was initially claimed to have been brought under control in seventy two hours, persisted in varying degree for over two months, the toll in death and destruction rising with the passage of time despite the measures reportedly taken by the State Government".
The report claims failure of intelligence, failure to take appropriate action, patterns of arrests, uneven handling of major cases, and "Distorted FIRs: 'extraneous influences', issue of transparency and integrity" as key factors in the incident(s).
[edit] Banerjee Committee
In September 2004, a panel appointed by the central government and headed by former Supreme Court judge UC Banerjee to probe the Godhra train fire concluded that the fire was accidental.[92][93] Its findings were challenged by the BJP and the Gujarat inspector-general of police. In October 2006, the Gujarat High Court ruled that the panel was set up illegally, in violation of the Commissions of Inquiry Act, 1952 which prohibits the setting up of separate commissions by state and central governments to probe a matter of public importance.[94]
[edit] Concerned Citizens Tribunal
The citizen tribunal headed by retired Supreme Court justice Krishna Iyer collected evidence and testimony from more than 2000 riot victims, witnesses and others. In its report, the tribunal accuses the state government and chief minister Modi of complicity in the violence. While Krishna Iyer was nominally part of this tribunal, he made it clear in the preface of the report that his involvement was very limited.[95][96][97]
[edit] Aftermath
Opposition parties as well as three coalition partners[98] of the BJP-led central government demanded the dismissal of Gujarat Chief Minister Narendra Modi for failing to contain the violence, with some calling for the removal of Union Home Minister L K Advani as well.[99]
On 18 July, Chief Minister Narendra Modi asked the Governor of Gujarat to dissolve the state assembly and call fresh elections.[100] The Indian Election Commission ruled out early elections, citing the prevailing law and order situation, a decision the union government unsuccessfully[101] appealed against in the Supreme Court.[102]
In August 2002 a plot by Lashkar-e-Toiba to assassinate Narendra Modi, Praveen Togadia, and other Sangh Parivar leaders was unearthed by Indian police. The terrorists were planning to set up a base in Gujarat and were trying to lure some of the riot-hit people into taking up "so-called jihadi activities" Delhi Police Special Commissioner (Intelligence) K K Paul said.[103]
In September 2002, at least 29 people were killed when Islamic fundamentalist gunmen engaged in the Akshardham Temple attack in the city of Gandhinagar in Gujarat. The Pakistani Inter-Services Intelligence and Islamic terrorist group Lashkar-e-Toiba were accused of supporting the terrorists.[104][105][106][107]
Elections were held in December and Modi was returned to power in a landslide victory.[108]
Emails made public by the perpetrators of a series of bombings in western India in July 2008 indicated that those attacks were "the revenge of Gujarat".
[edit] Relief efforts
Amnesty International's annual report on India in 2003 claimed the "Gujarat government did not actively fulfill its duty to provide appropriate relief and rehabilitation to the survivors".[71]
The state government initially offered compensation payments of 200,000 rupees to the families of those who died in the Godhra train fire and 100,000 rupees to the families of those who died in the subsequent riots, which local Muslims described as discriminatory.[109] Subsequently, the government set the compensation amount at 150,000 rupees. [110]
By 27 March, nearly 100,000 displaced people moved into 101 relief camps. This swelled to over 150,000 in 104 camps the next two weeks.[27] The camps were run by community groups and NGOs, with the government committing to provide amenities and supplementary services. Drinking water, medical help, clothing and blankets were in short supply at the camps.[111] At least another 100 camps were denied government support, according to a camp organiser.[112] and relief supplies were prevented from reaching the camps over fears that they may be carrying arms.[113]
Relief camp organisers alleged that the state government was coercing refugees to leave relief camps, with 25,000 people made to leave eighteen camps that were shut down. Following government assurances that camps would not be shut down, the Gujarat High Court bench ordered that camp organisers be given a supervisory role to ensure that the assurances were met.[114]
On 23 May 2008, the Union Government announced a 320 crore rupee (US $ 80 million) relief package for the victims of the riots[115].
[edit] Media coverage
Covering the first major communal riots following in the advent of satellite television to India, television news channels set a precedent by identifying the community of those involved in the violence, breaking a long-standing practice.[116]
Critical reporting on the Gujarat government's handling of the situation helped bring about the Indian government's intervention in controlling the violence.[116] The Gujarat government banned television news channels critical of the government's response. STAR News, Zee News, Aaj Tak, CNN and local stations were blocked.[116]
The Editorial Guild of India rejected the charge that graphic news coverage aggravated the situation, saying that the coverage exposed the "horrors" of the riots as well as the "supine if not complicit" attitude of the state, helping propel remedial action. The team also faulted Gujarati language papers Gujarat Samachar and the pro-Hindutva Sandesh of distorted and provocative reporting.[116]
The Godhra fire received extensive news coverage until it was overtaken by the subsequent violence and the presentation of the Union budget.[116] Television and newspaper reports, particularly local Gujarati language media, carried graphic and at times sensationalised images and accounts of the Godhra train fire.[117] S Gurumurthy, Arvind Lavakare and columnist Rajeev Srinivasan argue that news reports emphasized the provocative behaviour of the kar sevaks on the Sabarmathi Express in an effort to rationalise the subsequent mob attack at Godhra and displace blame from the mob on to the kar sevaks.[118][119]
In 2004, the weekly newspaper Tehelka published a hidden camera exposé alleging that a BJP legislator Madhu Srivastava bribed Zaheera Sheikh, a witness in the Best Bakery killings trial.[120] Srivatsava denied the allegation,[121] and an inquiry committee appointed by the Indian Supreme Court drew an "adverse inference" from the video footage, though it failed to uncover evidence that money was actually paid.[122] In a 2007 expose, the newspaper released hidden camera footage of several members of the BJP, VHP and the Bajrang Dal admitting their role in the riots.[123][124] Among those featured in the tapes was the special counsel representing the Gujarat government before the Nanavati-Shah Commission, Arvind Pandya, who resigned from his post after they were made public.[125] While the report was criticized by some as being politically motivated,[126][127][128][129] some newspapers said the revelations simply reinforced what was common knowledge.[124][130][131][132] The Gujarat government blocked telecast of cable news channels broadcasting the expose, a move strongly condemned by the Editors Guild of India.[133].
The riots were also the subject of a 2004 documentary film by Rakesh Sharma (filmmaker), called Final Solution (Gujarat Riots). The film was denied entry to Mumbai International Film Festival in 2004 due to objections by Censor Board of India, but won two awards at the 54th Berlin International Film Festival (2004)[134]

[edit] Atrocities against women
An international fact finding committee formed of experts from US, UK, France, Germany and Sri Lanka reported, "sexual violence was being used as a strategy for terrorising women belonging to minority community in the state."[135]
Taking a stand decried by the media and other rights groups, Nafisa Hussain, a member of the National Commission for Women accused organisations and the media of needlessly exaggerating the plight of women victims of the riots.[136][137][138] which was strongly disputed as Gujarat did not have a State Commission for Women to act on the ground.[139] The newspaper Tribune reported that "The National Commission for Women has reluctantly agreed to the complicity of Gujarat Government in the communal violence in the state." The tone of their most recent report was reported by the Tribune as "lenient".[140]
[edit] Riot cases controversy
In April 2009, the Special Investigation Team (SIT) setup by the Supreme Court of India to investigate and expedite the Gujarat riot cases submitted before the Court that Teesta Setalvad had cooked up cases of violence to spice up the incidents. The SIT which is headed by former CBI director, R K Raghavan has said that false witnesses were tutored to give evidence about imaginary incidents by Teesta Setalvad and other NGOs[141]. The SIT charged her of "cooking up macabre tales of killings"[142][143].
The court was told that 22 witnesses, who had submitted identical affidavits before various courts relating to riot incidents, were questioned by SIT and it was found that the witnesses had not actually witnessed the incidents and they were tutored and the affidavits were handed over to them by Setalvad[142].
The report which was brought to the notice of the bench consisting of Justices Arijit Pasayat, P Sathasivam and Aftab Alam, noted that the much publicised case of a pregnant Muslim woman Kausar Banu being gangraped by a mob and foetus being removed from sharp weapons, was also cooked up and false[141][144].
