Lok Sabha passes two bills without discussion!

Lok Sabha today passed within few minutes a bill on minority educational institutions and another on energy conservation without any debate because of uproar over a remark by a Trinamool member against a Left MP. The bills -- National Commission for Minority Educational Institutions (Amendment) 2009 and Energy Conservation (Amendment) Bill 2010 -- were put to vote even as BJP members protested the way these were rushed through by Speaker Meira Kumar. Chanting slogans like "this is murder of democracy", BJP members said there was no order in the House.

Their objection came as Left members trooped into the well to demand apology from Bandopadhyay for making certain expletive remarks against Acharia earlier in the day. Left members were continuously raising slogans and later they staged a dharna in the well.

The National Commission for Minority Educational Institutions (Amendment) Bill, 2009 was introduced earlier in the previous Lok Sabha, but later lapsed as it could not be passed because of stiff opposition from the Left. The bill is aimed at paving the way for setting up of minority educational institutions.

The Energy Conservation (Amendment) Bill 2010 introduced on March 8 by Sushilkumar Shinde was also passed. The bill aims to confer powers to Bureau of Energy Efficiency (BEE) to fix the criteria and procedures for accreditation of energy auditors.

The bill empowers the BEE to appoint its officers and staff to accredit energy auditors, a job presently done by government officials. It also empowers the central government to prescribe, by rules, the procedure for issue of energy saving certificate to designated consumers and the value of metric ton of oil equivalent of energy consumed.

It levies additional penalty for failure to comply with legal provisions.

Mumbai trains head towards normal after motormen end strike!

Mumbai local trains are heading towards their normal schedules. After a meeting with the Home Minister RR Patil, hundreds of motormen agreed to end their strike and go back to work. They've been demanding better pay and facilities. (Watch: Motormen's demands would be considered, says R R Patil)

A committee will be formed to decide on the demands of the motormen by June 15.

The decision comes at the end of a harrowing Tuesday for Mumbai with quiet offices, empty train stations, jam-packed roads.

Eighty of the trains on the Central and Western lines were cancelled through the day. Between them, the two lines usually run 3300 trains on a normal day for more than 60 lakh commuters.
 
Whether to apply ESMA (Essential Services Maintenance Act) remained a delicate issue. The Act means that any government employee who does not return to work can be arrested. The central government sanctioned the enforcement of ESMA, but Maharashtra Chief Minister Ashok Chavan said it would be "the last option."
 
In Parliament, the Railways Minister Mamata Banerjee came under severe criticism for the strike.  What made matters worse for her was that she wasn't present to take questions from angry Maharashtra MPs who joined forces across party-lines to ask what was being done to help commuters.
 
The Maharashtra government took the striking motormen to court. The Bombay High court is considering the case, but the judge has slammed the government for forcing motormen to put in overtime.  Not only is this exploitative, said the judge, but it also endangers commuter safety. Offices in Mumbai reported up to 90% absenteeism.
 
But those Mumbaikars who had to get to work had a tough time braving crowded roads and not enough public transport.  The government had organized buses at most major stations, but there weren't enough, said commuters.  Without trains to get to work, taxi drivers also chose to stay home. With cabs in short supply, the government made an exception, allowing taxis to accommodate more than  three passengers. (More trouble for Mumbai, Meru cabs on strike)

The Chief Minister had said that all college exams in the city would be postponed if the situation does improve by Tuesday evening.
 
Twenty motormen have been fired; another 170 have been detained for protesting at Chattrapati Shivaji Terminus (CST). (Read: 170 striking motormen taken into custody)

And despite holding the city to ransom, they seemed to enjoy the sympathy of Mumbai.  Commuters who spoke to NDTV in different parts of the city agreed that they should be granted the better pay and facilities that they're demanding. (Watch: Mumbaikars wait for resolution at stations)

After holding the city to ransom for two days, railway motormen called off their indefinite strike following talks with the state government today. The decision to bring Mumbai''s lifeline on track came shortly after Maharashtra government, edged on by parties like MNS, Congress and Shiv Sena to end the stir, mulled invoking provisions of Essential Services Maintenance Act (ESMA).

 

The motormen decided to call off their agitation after the state government gave an assurance to them that it would mediate between the strikers and the Railway ministry, Home Minister R R Patil after the meeting with representatives of the motormen. "The government took the lead to resolve the crisis as normal life was thrown out of gear due to the strike and people had to suffer lots of hardships," Patil said.

 

Earlier today, Shiv Sena chief Bal Thackeray said he would fight with the government on genuine demands of the striking motormen in Mumbai and asked them to resume work immediately. Maharashtra Navnirman Sena chief Raj Thackeray, whose party poll symbol is railway engine, also warned motormen to call off the strike or else face his party''s opposition.

 

Police cases against motormen of the Central and Western Railways, who have since called off their strike in Mumbai, will be withdrawn, Parliament was informed today. At the same time, the Railways will withdraw any disciplinary action against them, Minister of State for Railway E Ahmed said in the Rajya Sabha.

 

"The conciliation process was started by the Home Minister of Maharashtra. All cases registered by the police have to be withdrawn.

the disciplinary action by the Railways will also be taken back," he said.

The minister made the statement in response to demands by members in both Houses about the government''s stand over the strike which brought Mumbai to a halt since yesterday affecting suburban trains which ferry seven millions of people every day. A fast track committee is looking into the motormen''s demands for increase in salary and allowances, another Minister of State for Railways K H Muniyappa said in an identical statement in the Lok Sabha which saw repeated adjournments on the issue.

 

The committee "is expected to submit its report by June 15. Further action on the issue would require consultation and approval of the ministry of finance," he said.

 

Opposition members targetted Railway Minister and Trinamool Congress leader Mamata Banerjee for failing to avert the situation and was busy with Municipal polls in Kolkata.

 

However, Reduction in the duties of petroleum products dominated the list of demands made by the opposition during the discussion on the Finance Bill in the Rajya Sabha today. Initiating the discussion in the Rajya Sabha, Prakash Javadekar (BJP) praised Finance Minister Pranab Mukherjee and complimented him for the concessions announced but said that he should also consider reduction in the prices of petrol and diesel.

"You have accepted so many demands. Accept one more demand and reduce the prices of petrol and diesel," he said.

Javadekar said 100 percent taxation on petroleum products was a "loot" and asked how the government can milk one sector particularly when these were no longer luxuries. The BJP member also demanded implementation of one-rank one-pension scheme and action in the 2G scam which, he said, amounted to Rs 70,000 crore.

"Is it compulsion of coalition politics? Now caste card is also being played to defend corruption," Javadekar said. T Subbamarmi Reddy (Congress) quoted figures of petroleum price hike during the NDA regime and said it was much more than in the UPA regime.

He highlighted various proposals of the budget, particularly allocations in the social sector and infrastructure. Tapan Kumar Sen (CPI-M) said the tax proposal had a bias against the common man as much more has been imposed on him than given.

Raising the issue of petroleum price, he said in every one rupee of petrol, 51 paise is in the form of tax. "It needs to be thoroughly reviewed," he said.

Sen said there were alternative avenues for revenues and they should be explored. "Please correct the bias against the aam aadmi (common man)," he added.

Stock indices ended deep in the red Tuesday, as Europe's sovereign debt issues continued to rock global markets. All the sectoral indices were in the red with high-beta sectors like metals and realty being worst hit. India ranks second worldwide mong businessmen on the trade confidence level after the recent global financial crisis, a survey has

said.

 

RBI survey pegs inflation at average of 6-6.9 pc in 2010-11..

Most forecasters in an RBI survey pegged inflation at an average of 6-6.9 per cent in the current fiscal, which means it will decline in the later part of the year from the current level of 9.9 per cent.

"Forecasters have assigned the highest 29.6 per cent chance that it (average inflation) will fall to 6-6.9 per cent in 2010-11," RBI said, while clarifying that the views contained in the survey are not of the central bank.

Around 27.7 per cent of the respondents to the Survey of Professional Forecasters projected inflation at an average of 5-5.9 per cent in the year.

A few respondents, around 6.1 per cent, believe that average inflation will be in the range of 9-9.9 per cent, which means that inflation will remain stagnant more or less at the current level.

Inflation stood at 9.9 per cent in March, 2010. Economists believe that inflationary pressure will remain for some months even as food prices ease a bit on arrival of rabi crops and reports of a normal monsoon.

"The problem is non-food inflation. The manufactured product inflation is picking up. As of now, there is no case for euphoria. I expect April inflation to be 9.5 per cent. Inflation will be around 9.7 per cent in June and thereafter, it will start declining and would come down to 5.5 per cent by the fiscal end," HDFC Bank Chief Economist Abheek Barua said.

The Reserve Bank, too, expects overall inflation to come down to 5.5 per cent by March, 2011.

However, the RBI projected inflation to be 8.5 per cent by March, 2010, but it touched 9.9 per cent.

The survey was based on the response of 24 forecasters.

The country, with 133 points, ranks next to United Arab Emirates with 134 points on the global trade confidence level index, according to the survey conducted by Hongkong Shanghai Banking Corporation (HSBC).

Vietnam, with 132 points and Brazil with 129, are third and fourth respectively. France, with 95 points, was 17th and last in the index,with a very low confidence level,HSBC India Trade and Supply Chain Head Bhriguraj Singh told reporters here.

He said the survey had found that some markets, including Asia Pacific region, Latin America, Canada and Europe were in positive territory after the financial crisis.

A total of 5,120 small and medium exporters globally were respondents for the findings and were asked for their outlook for the next six months, he said.

He said emerging economies topped the index with 122 points against 106 points for developed markets.

Stating that the confidence level among Indian exporters remained upbeat, he said trade confidence in India grew to 133 points from 117 in the second half of 2009, which reeled under the impact of the global financial crisis.

Giving statistics, he said exports were around USD 12.4 billion in January 2009, but rose to USD 14.3 billion in January 2010.

Similarly, exports in February 2010 also increased to USD 16.1 billion from USD 11.09 billion in February 2009.

Exports in 2008-09 stood at USD 162 billion and marginally increased to USD 164 billion in 2009-10, he said.

He said the survey had found that 60 per cent of Indian exporters expect finance from banks to increase in the next six months, while 59 per cent are confident of having access to finance through banks.

 

 

The Indian market opened in the green taking cues from positive economic data from the US. However, the upmove lacked momentum and the benchmarks drifted lower as subdued Asian indices dampened sentiments. The sell-off intensified with negative opening of European markets.

According to dealers, traders seem to have pressed short sales as the indices slipped below crucial support levels. Volumes were also high towards the end of session, which is a worrying sign at least for short-term, they said.

"If Nifty remains below 5150 levels (which is strong medium-term support), then a steep fall may take the index to 5040-4980 levels in coming days. Short-term traders are advised to remain light and avoid over-leveraged positions as indices are witnessing selling pressure on higher volumes.

"We are advising caution as global cues are weighing on our markets. One can buy Nifty 5100 or 5000 strike price put to hedge the long position or portfolio," said Chandan Taparia, derivatives & technical analyst, Anand Rathi.

National Stock Exchange's Nifty closed at 5148.50 down 74.25 points or 1.42 per cent. The broader index touched a low of 5134.85 and high of 5250.15 in today's trade.

Bombay Stock Exchange's Sensex ended at 17137.14, down 248.94 points or 1.43 per cent. The index touched intraday low of 17101.96 and high of 17464.82.

Both the BSE Midcap and Smallcap Indices ended 1.75 per cent lower.

Amongst the sectoral indices, BSE Metals Index was down 3.93 per cent, BSE Realty Index fell 2.76 per cent and BSE Capital Goods Index declined 1.69 per cent.

Tata Steel (-5.63%), Hindalco Industries (-5.58%), Sterlite Industries (-4.46%), SAIL (-4.39%) and Ambuja Cement (-3.74%) led the Sensex decline.

HCL Tech (2.47%), PNB (0.50%), HDFC (0.41%) and Hero Honda (0.23%) were the only Nifty gainers.

Market breadth was negative on the BSE with 1,842 losers against 997 gainers.

European markets were in the negative territory as the economic woes continue. FTSE 100 was down 1.03 per cent, CAC 40 slipped 1.46 per cent and DAX moved 0.78 per cent lower. US markets are also likely to open in the red. At 4:30 pm, Dow Jones futures was down 0.40 per cent, S&P 500 fell 0.49 per cent and Nasdaq 100 slipped 0.49 per cent.

 

Mumbai railway motormen call off their strike

Mumbai: Mumbai''s railway motormen called off their strike after two days here following assurances from Maharashtra Home Minister R R Patil that all cases registered against them would be withdrawn and their demands would be looked into with some seriousness.

"There will be no action taken against the motormen. All cases registered against them would be taken back," said Patil. "All the motormen suspended would be allowed to resume their work," he added

Earlier today, over 170 motormen were detained under the Essential Services Maintenance ACT (ESMA) after it was imposed by the Maharashtra Government to force them resume their work with immediate effect.

State Chief Minister Ashok Chavan took the decision after an emergency meeting with senior railway police and state administration officials. Earlier, the Central Government had given a green signal to the State Government to impose ESMA on the striking motormen.

Earlier this morning, the Central Railway suspended 20 motormen under the Railways Act for their refusal to end their strike, terming it as illegal. Train services on Central and Western lines in Mumbai continue to remain badly affected, as the motormen have refused to end their indefinite hunger strike.

Central Railway authorities said they would run only 30 per cent of their services today. The motormen''s strike threw life out of gear for the city''s 70 lakh train commuters.

Around 1,000 motormen of both Central and Western Railways went on a hunger strike to press for higher pay scales and allowances from Monday morning, causing immense inconvenience to daily commuters.

The Railway Ministry contends that the motormen are demanding higher pay than what has been recommended by the Sixth Central Pay Commission and additional allowances, which are not included in the Pay Commission''s recommendations.

The ministry further said that some of their demands regarding national holidays and night duty allowances have already been met. It has asked the general managers of Central and Western Railways to take all necessary steps in coordination with the Maharashtra Government to ensure minimum inconvenience to daily commuters.

"Railway will not hesitate in taking the stringent action against those who are not heeding to our request," said Anil Saxena, spokesperson of Indian Railways. The striking motormen had earlier said their protest would continue for the next few days if their demands were not met.

In a surprise development, Attorney General G E Vahanvati today appeared in the Supreme Court in a case on behalf of an Uttar Pradesh Government body. The Attorney General, the senior most law officer of the Centre, is free to choose cases outside the brief he holds for the government.

But significance is attached to his appearance for arguing the case of Lucknow Development Authority (LDA), an organisation that comes under Government of Uttar Pradesh where Mayawati''s BSP is in power, relating to green belt in posh Gomti Nagar area of Lucknow. A fortnight ago Vahanvati appeared on behalf of the CBI in the Supreme Court when he had said the agency will consider Mayawati''s plea for closure of disproportionate assets case in view of the favourable orders passed by the income tax department on the issue of wealth accumulated by her.

 

CBI seeks trial against Sajjan Kumar in ''84 riots cases

CBI today sought initiation of trial of Congress leader Sajjan Kumar and others in a Delhi court in 1984 anti-Sikh riots cases, alleging the members of a particular community were targeted by them during the carnage. "This (riots) was not a work of a few persons.

The manner in which the incidents took place showed that it was getting support from a prominent person wielding greater control over the area. It was not a handiwork of a few ruffians," Special CBI prosecutor Y K Saxena told Additional Sessions Judge Sunita Gupta.

Rebutting the arguments of Kumar and other, CBI counsel alleged the members of a particular community was targeted during the riots though it showed tolerance. "The acts of the accused created a havoc.

There was evidence that Kumar was making inquiry during the riots as to how many persons were eliminated," Saxena said, alleging the family members of the victims were dragged and killed in the riots. He said the prosecution must be given an opportunity to prove its case after framing of charges against Kumar, former outer Delhi MP and other.

Rejecting the arguments of defence counsel that there were contradictions in the statements of witnesses, the CBI counsel said there were grave charges against the accused in their statements made before the probe agency. The court, which heard the arguments by CBI and the defence counsel for the last several days on framing of charges, reserved its order for May 15.

 

Bhopal gas tragedy survivors file RTI with PMO

A group of Bhopal gas tragedy survivors today filed an RTI application with Prime Minister''s Office (PMO) seeking to know whether it took into consideration the 1984 disaster while drafting Nuclear Liability Bill. Thirty-five protestors went to the PMO and filed the RTI. "We want to know whether the lingering concerns of the Bhopal disaster have been considered at all in preparing the draft of the civil nuclear liability bill," said Zulekha Bee, a survivor of the disaster who is on a protest since April 15 demanding the setting up of an Empowered Commission on Bhopal.

"Twenty-five years after the disaster, we are still waiting for the Prime Minister to set up an Empowered Commission for proper medical care and rehabilitation. What will be the fate of the survivors of a nuclear disaster?" she said.

Nawab Khan, secretary of Bhopal Gas Peedit Mahila Purush Sangharsh Morcha, said they wanted to know on what basis the maximum compensation amount was fixed in the proposed Bill. "As per the proposed Bill the maximum compensation payable in the event of a nuclear disaster would be USD 450 million which is even less than the USD 470 million paid to the people of Bhopal.

This amount did not even pay for five years medical bills for most of the victims," he claimed.

Kasab is a killing machine, must get death: Prosecution

Pakistani terrorist Mohammed Ajmal Amir Kasab is 'Satan, a devil' and 'a killing machine' and must get the death penalty for murder, the prosecution in the 26/11 Mumbai terror attack case said Tuesday.

In his arguments a day after Kasab was pronounced guilty by Special Judge M.L. Tahaliyani, Special Public Prosecutor Ujjwal Nikam said Kasab had been convicted for mass murder and waging war against India.

'If all these are read together, the maximum punishment is death and minimum is life imprisonment,' Nikam said.

'I am for maximum punishment and this submission is not with a sense of revenge - we don't seek barbaric justice - justice should meet the end,' Nikam argued.

Tahaliyani had Monday pronounced Kasab, 23, guilty on all 86 counts for the Nov 26-29 2008 mayhem that left 166 Indians and foreigners dead and 244 injured in Mumbai.

Nikam said that in Kasab's case, it was not just the murder but the way in which the murder was committed, and that the accused had the 'urge to kill' that shook the collective conscience of society.

This makes it 'the rarest of rare cases', not merely in terms of the number of deaths caused, but also the manner of causing the deaths and the high degree of cruelty make it an exception, he said.

Nikam further argued that Kasab did not only kill, but he 'enjoyed the killing', which shows his unscrupulous attitude and total disregard for human life.

Terming Kasab 'a snake in human form, Satan and Ravana both together, an agent of the devil, devil in human form and a disgrace to entire humanity', Nikam said that the terror attacks were carried out with previous planning and extreme cruelty in which even members of the police force were killed.

'Kasab killed people with design, without mercy. He and Abu Ismail were responsible for killing 72 people, including 14 policemen, and the victims were helpless, defenceless and there was no provocation,' Nikam said.

He said that Kasab and Ismail killed navigator Amarchand Solanki of the ship Kuber, 52 people in Chhatrapati Shivaji Terminus, seven in Cama Hospital, nine outside the hospital, two were killed in the Vile Parle taxi blast and policeman Tukaram Ombale, who sacrificed his life, but helped nab Kasab.

Among the victims were eight women and seven small children, besides 14 policemen.

'They (the terrorist duo) killed without discretion or distinction, young or old, Hindus, Muslims, Jews and Christians,' Nikam stressed.

Calling Kasab a 'killing machine', Nikam said that such machines were manufactured in Pakistan. He explained that Solanki, navigator of Kuber, was killed in a brutal manner butchered to pieces.

'In fact, Kasab, the name itself means a butcher,' Nikam said.

He added that Kasab remained unsatisfied with the wanton killing and wanted to kill more people at Chhatrapati Shivaji Terminus (CST).

Quoting from Kasab's confession, Nikam pointed out that the terrorist was disappointed that they were delayed by an hour in the voyage by sea and missed the huge peak hour crowds at CST that evening.

Demanding death penalty for Kasab, Nikam told Tahaliyani that this would meet the end of justice, serve as a deterrent not only to Kasab but also as a signal to like-minded people.

'If we don't award the death penalty (to Kasab), India would remain a soft target,' Nikam declared before Kasab's lawyer K.P. Pawar started his arguments.

The final judgement in the case, detailing the punishment for Kasab, is likely to be delivered Thursday.

 

US seeks Pakistan's help in Times Square bomb probe

The US sought help from Islamabad Tuesday to investigate the alleged involvement of a Pakistani immigrant in an attempted car bombing in New York City, officials said.

US ambassador Anne W Patterson made the request during a meeting with Pakistani Foreign Minister Shah Mahmood Qureshi.

Faisal Shahzad, identified as a native of the southern port city of Karachi, was arrested late Monday by US authorities for allegedly parking a car containing a homemade bomb in Times Square Saturday, officials said early Tuesday.

According to a statement, Shahzad was arrested at New York's John F Kennedy International Airport as he attempted to board a flight to Dubai after he was identified by customs and security officials.

Abdul Basit, a spokesman for Pakistan's Foreign Ministry, said Qureshi had assured the US ambassador that Pakistan would cooperate fully with the investigation.

'Our cooperation with the US against terrorism is a constant and ongoing process, and if the US needs our assistance on this particular issue we will do all we can,' Basit said.

DawnNews television reported that US authorities had provided information to officials in Islamabad about the suspect.

Shahzad travelled to Karachi on an Emirates airline flight July 3, 2009 and flew back August 3, it reported.

Shahzad was scheduled for court arraignment Tuesday in Manhattan.

'This investigation is ongoing, it is multi-faceted and it is aggressive,' US Attorney General Eric Holder said in confirming the arrest.

'As we move forward, we will focus on not just holding those responsible for it accountable, but also on obtaining any intelligence about terrorist organisations overseas,' he said. 'We are deploying every resource available and we will not rest until we have bought everyone responsible to justice'.

Holder said government agents were pursuing multiple leads and urged US citizens to remain vigilant for attempted attacks.

'It is clear the intent behind this terror attack was to kill Americans,' he said.

The suspect is a resident of the nearby state of Connecticut and is believed to have anonymously bought the 1993 Nissan Pathfinder with cash a few weeks before, the New York Times reported online, citing two sources briefed on the police investigation.

A New York police officer Saturday noticed smoke billowing from a park vehicle and discovered the bomb, which had failed to detonate. Authorities said the casualties could have been significant if the improvised device had exploded.

Police said the vehicle was loaded with petrol, propane gas tanks, fireworks and fertilizer.

Authorities were seeking to learn whether the suspect might have had contacts with militants in Pakistan or elsewhere. The investigation was transferred Monday to the international terrorism branch of the federal government's Joint Terrorism Task Force, two officials told the Times.

'It's a prominent lead that they're following, the international association,' the paper quoted a senior official as saying on condition of anonymity. 'But there's still a lot of information being gathered'.

 

U.S. arrests Pakistani-American over failed car bomb

A U.S. citizen has been arrested in connection with the failed car bombing in New York's Times Square last weekend but investigators continue to pursue leads, Attorney General Eric Holder said on Tuesday.

The suspect -- identified by Holder as Faisal Shahzad -- is of Pakistani origin, a law enforcement official told Reuters.

The New York Times said the man lives in neighbouring Connecticut and recently returned from a trip to Pakistan.

Holder said the suspect was arrested at John F. Kennedy International Airport in New York as he tried to take a flight to Dubai. Authorities in New York said he would appear in Manhattan Federal Court later on Tuesday.

"It's clear that the intent behind this terrorist act was to kill Americans," Holder said at an early morning news conference. "We continue to gather leads in this investigation, and it's important that the American people remain vigilant."

Sources said the arrested man is believed to be the buyer of the 1993 Nissan sport utility vehicle used to carry the crude bomb made of fuel and fireworks into Times Square as it was packed with people on a warm Saturday evening.

For New Yorkers who bore the brunt of the Sept. 11 attacks by al Qaeda militants in 2001, the scare was a reminder that their city of 8 million people is under constant threat.

"Investigators who were tracking the man were also exploring whether he or others who might have been involved in the attempted bombing had been in contact with people or groups overseas," the Times said, citing unnamed federal officials.

Law enforcement sources told Reuters that Saturday's attempted attack may have involved more than one person and could have international ties.

The hunt for the suspects has now been taken over by the Joint Terrorism Task Force, led by the Justice Department, as investigators pore over surveillance camera footage, the Pathfinder and the bomb parts for clues.

Pakistan is a key ally to the United States and other NATO countries fighting the Taliban in neighboring Afghanistan but is also seen as a training ground for Islamist militants.

'INTENDED TO TERRORIZE'

Street vendors selling T-shirts and handbags alerted police to the smoking and sparking Nissan Pathfinder that was parked awkwardly with its engine running and hazard lights on near a Broadway theater where Disney's "The Lion King" is performed.

The Pathfinder, with a license plate taken from a car now in a repair shop in Connecticut, was rigged with propane gas cylinders, gasoline cans, fertilizer, fireworks and timing devices when it was found in Times Square.

"I would say that that was intended to terrorize," White House spokesman Robert Gibbs said on Monday. "And I would say that whoever did that would be categorized as a terrorist."

The incident had little impact on Monday on a broadly stronger stock market and Treasury bonds stayed lower in a similarly muted reaction, with attention focused on encouraging economic data and reduced anxiety over Greece.

The registered owner of the vehicle told police he sold it three weeks ago without any paperwork to a 29- or 30-year-old man described as Hispanic or Middle Eastern, the sources told Reuters.

Several officials cautioned against drawing conclusions because the investigation was still in the early stages.

"I can't at this point rule in or out the possibility of international connections," said one senior U.S. intelligence official.

The Taliban in Pakistan said on Sunday it planted the bomb to avenge the killing in April of al Qaeda's two top leaders in Iraq. New York Police Commissioner Ray Kelly and Bloomberg have said there was "no evidence" to support that claim.

But former CIA analyst Bruce Riedel, who oversaw an Obama administration strategy review on Afghanistan and Pakistan last year, cautioned against dismissing a possible role of the Pakistani Taliban in the failed car bomb.

"They have said they want to attack inside the United States," Riedel said before the Times report, adding there was "a very serious possibility" the incident involved "some Pakistani-American who has never built a car bomb before in his life but who is being coached either by phone or Internet."

"It would be a mockery of justice if the death penalty is not imposed," chief prosecutor Ujjwal Nikam said.

Mohammad Ajmal Amir Qasab, a Pakistani aged 22, was found guilty on Monday of charges including murder, waging war on India and possessing explosives.

The attacks left 174 people - including nine other gunmen - dead and soured relations between India and Pakistan.

India blames Pakistan-based militants Lashkar-e-Taiba for the attacks.

After initial denials, Pakistan acknowledged that the attacks had been partially planned on its territory and that Qasab was one of its citizens.

'Indian justice'

On Tuesday Mr Nikam, the public prosecutor, spent more than two hours arguing that Qasab should be given the death penalty, the BBC's Prachi Pinglay in court in Mumbai says.

"He is an agent of the devil himself, a disgrace to society and the entire human race," Mr Nikam said, the AFP news agency reports.

He described Qasab as a "killing machine who has no human feeling" and said a life sentence would leave India "a soft target" for extremists.

He said Qasab's crimes involved "focused, meticulous and detailed" planning to kill police officers and civilians.

India's media hailed Monday's verdict as "honourable", and said the acquittal of two Indians accused of helping the gunmen proved police had made a "poor case" of it.

The Hindu newspaper said that the judgement would "not grant closure" to survivors and families of victims of the attacks.

"This is because key conspirators, helped by a half-hearted investigation in Pakistan, are yet to face a court of law," the newspaper said.

The paper said the verdict was a "tribute to the independence of the Indian judicial system and its ability to deliver justice dispassionately".

According to the Times of India the verdict was "unlikely to be the end of the matter".

The newspaper said prosecutors planned to challenge the acquittals and that Qasab's lawyer could also contest his client's conviction.

Proceedings in the Mumbai trial have gone on for 14 months.

Late last year, Pakistan charged seven people in connection with the attacks, including the suspected mastermind Zaki-ur-Rehman Lakhvi, who is alleged to head Lashkar-e-Taiba.
