Mumbai High Court refers Lavasa case back to MoEF
Hearing of Lavasa and NAPM ordered for 9th Dec and decision by 14th Dec
A Bench of Hon'ble Justice D.K. Deshmukh and Hon'ble Justice Desphpande heard the case filed by the Lavasa Lake City Corporation demanding vacation of stay declared by the Central Ministry of Environment and Forests (MoEF), clubbed with the case filed by the National Alliance of People's Movements (NAPM) on the issue of illegality in Lavasa's work without environmental clearance.
Lavasa, through its advocate, Shailendra Mehta argued that there was a major delay in the petitioners, NAPM and others as well as MoEF raising the issue of clearance since much of construction has already taken place, Adv. Y.P. Singh pleading for the petitioner organization on the other hand argued that the delay was because of the political clout, support and pressures since Supriya Sule herself held more than 21% of the shares of Lavasa. The company also showed its readiness to commit not to start work till the 14th December, requesting the Court to vacate the status quo by MoEF.
Mr. Jal Khambata, Additional Solicitor General argued on behalf of the State (MoEF), justifying the stop-work and show cause notice by the Ministry. Adv. Y.P. Singh pointed out a number of violations by Lavasa, beyond those referred to in the MoEF's notice dated 25th November, 2010.
The High Court on hearing both the sides directed the Ministry of Environment and Forests to hear both Lavasa and NAPM on the 9th of December and take a final decision on whether or not the stay / status quo on the work at Lavasa is to continue.
NAPM welcomes the interim order and would present its case before MoEF on the 9th instance.
